Gilbert, Director of Public Works DATE: February 11, 1992 (Council Meeting 2- 19 -92) SUBJECT: Consider Fee Increase for Engineering Services DISCUSSION A. Retainer In March of 1991 the City entered into an Agreement for City Engineering Services with Charles Abbott Associates. Section I(A) of the Agreement provides for an automatic adjustment of the retainer services on November 1, 1991, in an amount equal to the change in a specified Consumer Price Index (CPI) for a specified period of time. Section I(B) sets forth similar language for an adjustment to the retainer for Traffic Engineering services. The amount of the change in the specified CPI is 3.8 %. The following chart shows the increase in these retainers when adjusted (rounded to the nearest dollar) by this factor. Service City Engineer Traffic Engineer B. (I) of the Agreement also provides for a similar change in the hourly rates for other Engineering services provided under the Agreement. Waiver of Notification Requirement The Agreement states that the rates for various Engineering services may be adjusted on November 1, 1991. This Section requires, however, that the City be notified at least f orty -f ive ( 45 ) days prior to the date of the proposed rate adjustment. The request from the City Engineer for this change was received by the City on January 22, 1992. It is recommended that the forty -five (45) notification requirement be waived. Due to the effort required to recompute the amounts due for past invoices already paid, it is not recommended that these rate adjustments be made retro- active to November 1, 1991. Instead, it is recommended that they be made effective March 1, 1991. RECOMMENDATION Staff recommends that the City Council take the following actions: 1. Receive and file this notification of an automatic 3.8% increase in the City Engineer's retainer retroactive to November 1, 1991. 2. Waive the forty -five (45) day notice requirements for an increase in the hourly rates for Engineering services and approve a 3.8% increase in said rates effective March 1, 1992.
