The cost of the insurance is borne by the instructor unless they participate in the Southern California Joint Powers Insurance Authority (SCJPIA) special event insurance program. If they participate in this insurance program, the premium is added to the normal class fees and is paid by each participant. The City collects the class fees, subtracts the premium from the fees and then the net fees are divided between the instructor and the City. The instructor receives seventy percent (70 %) and the City receives thirty percent (30 %) of the net fees. In some cases, the additional premium for special event insurance raises the cost Of the program to a point where it might discourage partic_pation. To calculate the premium we consider the nurber of participants in the class, the length of the class, and the duration of the program. This establishes the total participant hours. For an example, in an instructional class which has ten participants for one hour per week for ten weeks there are one hunired participant hours (10 x 1 x 10 = 100) . The premium for 1 to 100 participant hours is $45.18 divided between the participants or $4.52 each ($45.18/10 = $4.52). If there were just five participants in the class, the premium would still be $45.18, so each participant would pay $9.04 ($45.18/5 = $9.04). At issue is whether or not the additional insurance protection is worth the continuation of the instructional class. Instructional classes which have minimal exposure or risk are listed on the SCJPIA special event hazard one schedule. In those cases where the exposure is ninimal, it is requested that the risk manager have the discret_on to waive the insurance requirement if the cost of the special event insurance unduly increases the cost to participants in he recreation program instructional class. The risk manager would identify the content of the instructional classes before making a determination whether or not the instructional class should be assigned to hazard schedule I, II, or III. If the class falls into hazard schedule I and the instructor doesn't have available insurance the risk manager will determine whether or not the additional special event insurance cost unduly increases the cost of the class to the participants. If it does, then waiver of the fees will be considered. Recommendation It is recommended that the City Council authorize the City's risk manager (Deputy City Manager) to waive insurance requirements for recreation instructional classes which are classified on the SCJPIA Hazard I Schedule if the cost of special event insurance unduly increases the cost of the class to the participants.
