Richards, Director of Community Development DATE: February 28, 1992 (for 3 -4 -92 City Council meeting) SUBJECT: McDonald's Corporation Entitlement Application - Commercial Planned Development application and Parcel Map Background: To date, McDonald's Corporation has not submitted a complete entitlement application. Staff has been working with the applicant regarding design issues and entitlement case processing. When the application is deemed complete, it is my intention not to retain a consultant for case processing of this entitlement request. This decision is in part due to the following: staff has fewer entitlement cases than was anticipated; and the use of the part time Associate Planner can increase after March 1992. Discussion: The General Plan update is proposing to change the General Plan Land Use designation on the subject site from VH, Very High Residential to C -2, General Commercial. Given that McDonald's Corporation is proposing a land use consistent with the Updated General Plan land use designation of C -2, the Planning Commission may take no action to reach a final decision on this entitlement request until the General Plan and zone change have occurred. McDonald's Corporation has identified that they are anticipating having a complete entitlement application within 1 month. Once the application is deemed complete, processing of this entitlement application should take approximately 3 months. Based upon the size of the proposed development, 3,185.00 square feet, this entitlement request will be only be considered and acted upon by the Planning Commission unless the decision is appealed to the City Council. Mayor Mayor Pro -em Councilmember Councilmember Coun.:ilmember The Honorable City Council February 25, 1992 Page -2- Commercial Planned Development: $1,779.00 Land Division Map: $2,910 + $56.65 Environmental Review: $730.00 Traffic Model Study: $219.00 Preliminary Review Fee: $730.00 Total initial fees to be deposited: $6,424.65 The applicant will be required to submit a reimbursement agreement, agreeing to pay for all of staff's time and agency review time associated with entitlement processing of this application. Anticipated Entitlement Case Processing: Based upon similar entitlement applications, staff is anticipating that processing of this entitlement request will total approximately 225 hours, additional hours may be needed as warranted. The above estimate of staff processing time is based upon the following: Preliminary Review; thus far in the entitlement application process, staff has spent roughly 25 hours on this entitlement request. Similar case processing of Commercial Planned Development and Parcel Map applications have totaled approximately 150 hours of staff time. Additional hours will probably be spent reviewing a relocation program for those persons displaced as a result of development of this site. Additionally, an environmental review will need to occur for the proposed McDonald's site. Staff will need to coordinate its determination regarding pedestrian and vehicular traffic with the City Traffic Engineer. Fees Alreadv Submitted /Fee Estimate of Processina: McDonald Is Corporation has already deposited $23,000.00 to the City to cover costs associated with consultant services and staff administration. However, effective April 13, 1992 staff initial application case processing of this entitlement request will total $6,424.65. Staff is anticipating that processing of this entitlement application will be above the initial deposit amount of $6,424.65. It is staff's recommendation to retain the balance of the initial deposit for entitlement case processing expenses associated with Planning Staff time, City Engineer review, City Traffic Engineer time, and City Attorney review. Staff is recommending to contact McDonald's Corporation to determine if it is acceptable to them if staff retains the balance of the initial deposit. Should this financial arrangement be unacceptable to the Council, staff will retain a deposit of $16,425 which will only cover anticipated costs associated with the Planning Department's processing of this entitlement request, and will require that McDonald's Corporation enter into an agreement consenting to pay The Honorable City Council February 25, 1992 Page -3- for all costs incurred by the City and the City's agents as a result of processing this entitlement application. Recommendation: Staff's recommendation is: 1). That the Council reverse their prior decision to use a consultant and authorize the Director of Community Development to use in -house planning staff to process the entitlement requests of the CPD and LDM as proposed by McDonald's Restaurant, and; 2). That the Council concur with staff's recommendation to retain the $23,000.00 deposit made by McDonald's Corporation. �` A:McMarcCC.mem
