SUBJECT: A Resolution to Enable the Enforcement of the
California Vehicle Code at 111 Los Angeles Avenue
(Moorpark Town Center)
OVERVIEW
This presents for consideration at a public hearing, a
resolution making the private roads and parking areas in the
Moorpark Town Center (located at the northwest corner of
Moorpark Avenue and Los Angeles Avenue) subject to the
provisions of the California Vehicle Code (CVC).
DISCUSSION
A. Authority
The City has been enforcing the CVC in a number of - privately
owned parking areas in commercial shopping centers and multi-
family residential developments, including the subject
property. Enforcement of the CVC on private property
requires the adoption of a resolution by the local agency at
the request of the property owner. It was recently
discovered that such a resolution had never been adopted for
the Town Center property. Accordingly, the City suspended
enforcement on the subject property until the proper
authority is established.
The continued enforcement of the CVC has been requested by
the property owner (Exhibit 1). The Property Manager will
continue to provide and maintain adequate signs giving notice
of this enforcement.
B. Notice
The property owner and property Manager have been notified of
this public hearing, pursuant to the provisions of the
California Streets and Highways Code.

C. Prior Citations
As indicated above, citzzions i ss-ued on the subject property
in the past were not suroorted by the resolution required by
the CVC. It would be appropriate, therfore, to grant any
requests received for a dismissal of any citation, or a
refund of any fines paid, for any such citation issued within
the last thirty (30) da_.-s.
RECOIL JUNDED ACTION
Staff recommends that the Cite Council take the following
actions:
1. Adopt the attached resolution declaring certain roads and
parking facilities on private property subject to the
California Vehicle Code.
2. Authorize the City Manazer tc disniss any pending citation,
or refund any fines paid for any citation, issued for any
;olation of CVC Sec. 211-07.8 on the :pub j ec:.t roperty within

Dear Mr. Gilbert;
Per our conversation last week, this letter shall serve as a
written request from the Owners of the Moorpark Town Center, to
resume the City's vehicle code enforcement at the property. We
agree that speeding and illegal parking should be controlled by the
Moorpark Law Enforcement Agency.
The Ownership has also employed a private security service to deter
loitering, vandalism and to maintain a safe environment for tenants
and their visitors. We appreciate your continued cooperation with
the security officers.

SUBJECT: Parking Enforcement at Moorpark Town Center
Corner of Moorpark Avenue & West Los Angeles Avenue
This memorandum is to advise you of my intention to have Code
Enforcement Officers cease from conducting general parking
enforcement activities at the above subject site. This decision is
based on information I received from Ken Gilbert dated December 24,
1991 which listed private properties within the city which had, by
resolution, made parking enforcement possible at the locations
listed (see attached memorandum). The Moorpark Town Center is not
on the list.
Additional research was accomplished by Colleen Daleske, Records
Clerk, on January 14, 1992. Nothing was found to indicate that a
Resolution allowing parking enforcement at the site had ever been
approved by the City.
I intend to instruct Off icers Mancino and Riley to cease from
issuing citations at the Town Center, except for cases involving
Handicap parking violations.
Please advise of any information which you may have that may effect
this decision. Should we give written notice to the Sheriff's
Department? Will Ken Gilbert or another research the County files
on this matter?
