Gilbert, Director of Public Works DATE: March 10, 1992 (Council Meeting 3- 25 -92) SUBJECT: Consider Initiating Proceedings to 1) Annex Certain Property to Assessment District 84 -2 and 2) Add a New Zone of Benefit for the Improvement and Maintenance of the PC -3 West Village/Home Acres Open Space Buffer OVERVIEW This requests authorization to proceed witi efforts required to levy as-sessments on certain properties, to fund the development and fut- -re maintenance of a landscaped area at the west end of West Village UWC) adjacent to Home Acres. DISCUSSION A. West Village The City -as granted entitlement to Urban West Communities for -.he development of West Village (Tract Nos. 4340, 4341 & 4342) . one of the conditions of approval for that developme-_= was the establishment of a buffer area on certain property = dentified in Exhibit 1. B. Join Powers Agreement In =hat t:ze properties to be benefitted by this proposed buffer arsa are located both within and outside the City of Moorpark, the City and the County of Ventura have entered into a J�int Powers Agreement relative to these matters. Said Agre =went includes language which sets forth certain para-seter_ for the funding of the development and maintenance of t'-is b_ ffer area. Said parameters p-ovide for the levying of assess-.ents upon all of the properties benefitted by the proposed improvements. The Agreement stipulates that all suc' cost_ are to be split 50 -50 betwe =n the benefitted area city and the area known as gone Acres. Preliminary Design / Cost Estimate Staff has developed a preliminary cost estimate for the design, construction and future maintenance of the proposed park. These costs are set forth as follows: Cost Estimate Range ($� Element Low High A. Assessment Engineering 600 1,500 2,100 x 12 25,200 The City has retained the services of Dwight French & Associates to provide assessment engineering services required for the administration of the City's Assessment Districts. Attached is a proposal from that firm for services required to consider 1) annexation of the area outside the City (Home Acres) to Assessment District 84 -2, and 2) the establishment of an additional Zone of Benefit for the levying of improvement and maintenance assessments for the subject buffer area. The total amount of fee for these services is $4,155. If directed to proceed, these costs will be advanced from the existing fund balance in AD 84 -2 and recovered by assessments levied the first year. In addition to the Assessment Engineer's fee, there will be other incidental expenses related to posting and mailing of notices and other such requirements. These start up costs would also be advanced and recovered in the manner described above. West Village Buffer Page 3 E. Estimated Annual Assessment The tasks required of the Assessment Engineer will include a) the development of an inventory of properties to be assessed; b) the development of final improvement and maintenance costs; c) the development of a benefit spread fornula; and, d) the calculation of the recommended annual assessments to be levied. The amount of the annual assessment is not known at this _ time. However, it is the intent of staff to direct the Assessment Engineer to spread the proposed Improvement Assessments over a two to three year period. By doing so it is expected that the initial annual assessment will be approximate $20 to $25 per household. Each year this matter will be revisited by the City Council as a part of the annual Assessment District renewal process. The amount of the assessment levied each year will be determined by the City Council based on actual cost factors related to the improvement and nain-enance of this facility. RECON3ENDATION Staff recommends that the City Council take the following actions: 1. Approve an amendment to the Scope of Work for Assessment Engineering Services now in progress, to add thereto efforts required to consider 1) the annexation of Home Acres to Assessment District No. 84 -2; and 2) the establishment of a new Zone of Benefit to. fund the design, construction and future maintenance of the West Village Buffer Park. 2. Authorize the expenditure of $4,155 for this purpose. 3. Authorize the City Manager to sign a letter of agreement with the Consultant to this effect. Research Obtain assessor's maps from the County, identify residential and commercial parcels within the area. 2. undary Map Revise current boundary map to Include area to be annexed. - - 3. Prepare Preliminary Assessment Using cost estimated by City staff, a distribution of the assessment will be performed. 4. Review with Staff The preliminary distribution of the assessment will be reviewed with staff. Minor adjustments may be made as necessary. 5. Prepare Report An Engineer's Report will be prepared for the area to be annexed, the additional zone will be included in the report. 6. Notice gf Hearin g Prepare mailing labels and send Notice of Hearing to property owners with the area to be annexed. 7. Public Hearing Attend and present information or respond to questions as necessary to the public and council. 8. Finalize Engineer's Report Based on comment from Task 7, update Engineer's Report and revise assessment roll.
