SUBJECT: INDUSTRIAL PLANNED DEVELOPMENT PERMIT NO. DP -304 MINOR
MODIFICATION NO. 1 (G.T. WATER PRODUCTS AND MARK
DISTRIBU"1'ORS, INC.)
SACKGROUND:
On August 28, 1984, the p1=-fining Commission approved Development
Plan No. DP -304, on the app' - cation of Moorpark -L.A. Properties, to
allow the construction of a 22,912 square foot industrial building
on 1.16 acres located at 52:: Commerce Avenue. The subject property
is zoned M -2, Limited Indus =rial.
The current owners of the subject property are George and Debra
Tash, who own and operate G.T. Water Products and Mark
Distributors, Inc.. Mr. a.-3 Mrs. Tash have requested a Minor
Modification to DP -304 tc allow the operation of a combined
elementary school and sec :ndary school on -site for employees,
children. A school for chil'ren ages 5 through 14 has actually been
operating successfully at tie Commerce Avenue site for the past 3
1/2 years.
When the applicants starter their company- sponsored school, they
were unaware that it required any special approval from the City.
At the time the school was = tarted, the Zoning Code did not allow
a school in the M -2 Zones. 3n September 5, 1990, the City Council
initiated an amendment to tie Zoning Code to allow the operation of
schools and day care facil -ties in both industrial and commercial
zones with approval of a Modification to a Planned Development
Permit. That Zoning Code amendment was initiated specifically
because of the G. T. Watt- Works school, and was subsequently
approved by the City Counc_: in conjunction with approval of a new
City Zoning Code.

Discussion:
Staff is recommending approval of the request for a Minor
Modification to DP -304 based on consistency with the Zoning Code
and based on staff's investigation of the site and surrounding
businesses. Staff made a site visit and observed the exterior noise
levels of the adjacent businesses. Staff's conclusion is that the
G. T. Water Works business and the existing industrial tenants
adjacent to the school site would not currently be expected to
expose children to obnoxious odor, excessive noise, or a hazardous
materials incident which would affect human health. However,
because industrial tenants can change over time, staff is
recommending that the attached conditions of approval be imposed in
conjunction with the Minor Modification approval.
Staff contacted the Fire Department to learn what the potential
would be for a hazardous material incident. The Department of
Building and Safety and the Fire Department have made site
inspections and have determined that the existing industries would
not be expected to expose children to obnoxious odors, excessive
noise, or a hazardous materials incident. As a precautionary
measure, both Departments have required fire dampers, additional
smoke alarms as well as additional structural improvements as a
precautionary measure.
Condition No. 1 requires continued sponsorship of the school by the
existing industrial use on -site. Condition No. 2 requires the
applicant to apply for a Zoning Clearance on a yearly basis to
allow continued operation of the school use. Staff would then make
a site visit and research fire department, Air Pollution Control
District and business registration records to ensure that adjacent
businesses did not pose a health risk to students.
Community'Development Director's Action
The Director of Community Development has reviewed the proposed
Minor Modification and intents to conditionally approve it.
Pursuant to Resolution No. CC -88 -523, the Director of Community
Development has the authority to approval Minor Modifications. This
matter is being presented to the City Council as a courtesy. Should
the Council desire to appeal the Director's decision, a public
hearing date should be scheduled. The next available meting date
would be the Council's next regularly scheduled meeting of April
15, 1992. If the Council takes no action on this Minor
Modification, then the Director's decision stands.

DP -304, MINOR MODIFICATION NO. 1
CONDITIONS OF APPROVAL
1. Operation of an elementary school and secondary school on the
DP -304 site is allowed subject to continued sponsorship by the
industrial use on the same site and compliance with the
following condition.
2. The applicant, or designated representative, shall be required
to apply for a Zoning Clearance, on a yearly basis, to allow
continued operation of a school on the DP -304 site. The
purpose of the Zoning Clearance shall be to review the
existing industrial use on -site as well as the adjacent
businesses to ensure that students will not be exposed to
obnoxious odors, excessive amounts of noise, or a hazardous
materials incident which would affect human health. The first
Zoning Clearance must be applied for within one -year from the
approval date of the Minor Modification.
