SUBJECT: Consider Approval of a Temporary Commercial Refuse
Permit
Background
The City of Moorpark has a non-exclusive temporary refuse
collection permit which includes a 10 percent franchise fee payable
quarterly to the City. Temporary service is defined as " . . .that
which is provided on a non-regularly scheduled, and less than
weekly basis. Construction, demolition, and land clearing projects
would be typical types of temporary service. " The definition
includes temporary requests made by commercial businesses that have
on-going accounts with a hauler. Any refuse hauler wishing to
provide commercial refuse collection to a Moorpark business
requesting temporary service must apply to the City and pay a fee
of $500 for the one year permit period, which runs October 1
through September 30.
On September 18, 1992, Council approved temporary commercial refuse
collection permits for G. I. Industries, Anderson Rubbish Disposal,
and E.J. Harrison & Sons for a one-year term effective October 1,
1991. The temporary commercial permit is non-exclusive, haulers
may apply for a permit anytime during the term period and will be
subject to a pro-rated fee for the permit.
Although Rubbish Control does not have a permit, they did provide
temporary refuse collection service to Southern Pacific for the
asbestos removal project on the vacant bank building located on the
corner of High Street and Moorpark Avenue. As soon as staff was
made aware of their activities, Rubbish Control was notified that
they would have to discontinue temporary collection immediately or
formally indicate their intent to apply for a permit.
Rubbish Control has formally requested a temporary commercial
refuse collection permit to provide temporary service in Moorpark.
It is currently one of four haulers with an exclusive commercial
contract authorized to provide collection services in the City.
The letter from Rubbish Control states that it agrees to the terms

of the contact and will provide the pro-rated fee of $291 . 81 (March
1, 1992 - September 30 , 1992) and all necessary contract
requirements upon approval by City Council of the permit.
Recommendation
Staff recommends that Council award a temporary commercial refuse
collection permit to Rubbish Control and authorize the Mayor to
sign the agreement between the City and Rubbish Control for the
temporary commercial non-exclusive collection of solid waste.
