Richards, Director of Conmmn ty Development DATE: March 13, 1992 (CC meeting of 3/25/92) SUBJECT: ORDINANCE TO REVISE THE APPEAL PERIOD FOR APPEALS TO CITY DECISION - MAKING AUTHORITIES TO 15 DAYS FROM 10 DAYS Background The City's previous Zoning Ordinance indicated that the appeal period for appeals to City decision - making authorities shall end fifteen (15) calendar days after the decision being appealed is rendered. When the City's current Zoning Ordinance was approved, there was an inconsistency between the appeal period of the previous Zoning Ordinance and the existing Ordinance. Pursuant to Section 8111 -8.3 of the City's current Zoning Ordinance, the appeal period for appeals to City decision - making authorities shall end ten (10) calendar days after the decision being appealed is rendered. The Old Ordinance (No. 57) had changed the appeal period from 10 to 15 days in 1985. The City Attorney is of the opinion that the most recent adopted appeal period of ten (10) days applies. Discussion At the City Council meeting on March 4, 1992 regarding Appeal 92 -2, the Council noted that the current Zoning Ordinance had a shorter appeal period than the City's previous Zoning Ordinance. Section 8115 -1 of Article 15 of Chapter 1 of the Zoning Ordinance of the City provides that the City Council may initiate proceedings to consider amendments to the Zoning Ordinance by the adoption of a resolution requesting the Planning Commission to set the matter for public hearing, report, and provide a recommendation to the City Council. Staff is of the opinion that a fifteen (15) day appeal period should be established to allow adequate time for the City Council and the public to file appeals.
