Rubin, Management Analyst (- DATE: March 19, 1992 (3/25 Council Meeting) SUBJECT: Opposition to AB 3213 (Cigarette Tax Revenue) and SCA 41 (Vehicle License Fees) Background AB 3213 (Isenberg) would implement the Governor's budget proposal to shift all of the remaining Cigarette Tax revenue from cities and counties to the state general fund. According to the League of California Cities, the State took forty -seven (47) percent of cities' Cigarette Tax revenue as part of the State's budget balancing actions for 1991/92. This action included sunset language that would return the revenue to cities after five years. If implemented, AB 3213, would allow the State to permanently take all Cigarette Tax revenue. AB 3213 was recently introduced and has not been assigned to a committee. SCA 41 (Watson), would ensure that those revenues derived from the Vehicle License Fee (VLF) increase on July 1, 1991, for state and county realignment of health, mental health, and social services programs, be guaranteed for counties. However, by specifying that any increases on or after July 1, 1991 would be earmarked, cities would be permanently excluded from any future increases in VLF. SCA 41 will be heard by the Senate Local Government Committee on April 1, 1992. Recommendation Staff recommends that the City Council authorize the Mayor to draft letters to the State Assembly Member and Senator representing Moorpark in opposition to both matters, and to the Senate Local Government Committee Members in opposition to SCA 41.
