Richards, Director of Community Development Date: March 20, 1992 (CC hearing 4/1/92) Subject: PD 941 Minor Modification No. 1 (Goerisch) Background Tentative Tract No. 3525 and related Planned Development Permit No. 941 were approved by the City Council on September 16, 1985 for the construction of 217 single family homes by Warmington Homes Inc. The subject site is located at 13197 Sleepy Wind Street. The proposed new garage location is on the east side of the house, facing Peach Hill Rd. which is 21' from the new garage, down a slope from the house. Discussion This request for a Minor Modification singleocarDgarage to a for single construction of a new 329 square family dwelling having an existing two car garage. The Director of Community Development intends to condition this reauest for a Minor Modification to require that the exterior colors and materials for the proposed addition be the same as the existing residential structure. The Fox Shadow Homeowners Association approved the modification on September 16, 1988. This proposal has been reviewed by the Director of Community Development who intends to approve it on March 23, 1992, with the Appeal period ending on April 2, 1992. Pursuant to Resolution No. 88 -523 the Director has the authority to approve Minor Modifications. This matter is being presented to the Council as a courtesy. If the Council takes no action, then the Director's decision stands. In the interest of improving service to the community the Director will approve this application prior to the hearing date. This will eliminate the need for the applicant to wait an additional ten days during the appeal period, while still allowing the Council the opportunity to appeal.
