Richards, Director of City Courodl Meeting nCTION: =y UAY , Z'fL Community Development DATE: March 25, 1992 (for the April 1, 1992 City Council meeting) SUBJECT: Weekly Farmers Market /Antique Festival Background: Owners of an approximately 15,000 square foot parcel of vacant land at the northwest corner of Magnolia Avenue and High Street in downtown Moorpark have indicated an interest to hold a weekly Farmers Market /Antique Festival on their property. The owners are requesting that the City consider using a Temporary Use Permit process to sell various items from the site on a regular basis. The items to be sold include: Certified produce, pursuant to Department of Agricultural Guidelines, antiques, and food merchandise. Free entertainment such as music and balloon tying will be available. The owners are interested in creating a fun "flea market" environment. The owners of the parcel have been working with the Chamber of Commerce and have received positive feedback from the Chamber regarding this issue. In the past, the Council has used the Temporary Use Permit process (See Attachment 2), to allow the following uses on a 6 month evaluation crtieria: * Outside Eating * Live Entertainment * Outside Produce Sales * Outside Cooking Inasmuch as the applicant's requested permit does not specifically fall into the parameters of acceptable uses for which a Temporary Use Permit is to be granted; the interested owners are requesting RAT- 0:- 25- 92(1:19pm)A: \FARMERSM.M6M PAUL W. Temporary uses are usually regulated by conditions. Should the Council wish to grant the Temporary Use Permit to the applicant, appropriate conditions of approval will need to be added so as to reduce or eliminate problems between land uses. Potential conditions of a Tempoary Use Permit for the subject site may include the following: a. Paving of the site or some form of dust control; b. Limit hours of operation; C. Limit the types of products sold on site; d. Obtain necessary permits from the Health Department; e. Provisions for water and electric outlets; f. Provisions for sanitary facilities; g. Traffic control measures; h. Regulate on -site lighting; i. Noise conditions; j. Regulate types of signs used; k. Regulate parking requirements. We would like to propose an event that would accomplish both of these goals by having a weekly Farmers Market / Anitque Festival event on the property. We have had meetings with Carol Hunt at the Chamber of Commerce and Pat Richards, Director of Community Development and attented the recent round table discussion held on February 25, 1992. One of the main concerns downtown is for customer /business attraction. We have experienced enthusiasm for this concept, but have met with some difficulty in trying to secure a 6 month temporary use permit. As this Farmers Market/ Antique Festival is not a long term plan for the property, a temporary use permit is the only vehicle for us to proceed forward. The guids lines for this permit seem irrelevant when the „ parallel is generating downtown interest and attracting more business revenue for existing merchants. We are asking that the Council revoke and /or amend these guidelines so that an event like this can proceed forward. A quick fix to the temporary permit is not going to heir) when, in the future, other motivated people want to create a public and business interest event. We urge you to change the existing restrictions keeping the future in mind. We would like your support of this project. A timely response is required in order for this event to be launched. We appreciate your consideration and a prompt response is requested. Richards, Director of Community Development DATE: August 20, 1990 (CC meeting of 9/5/90) SUBJECT: Downtown Revitalization - Temporary Use Permit Background In August 1989, the Council approved the final text of the Downtown Study and directed the Community Development Committee to work with Staff to implement the basic design elements of the study. Since that time there has been a joint meeting with the Planning Commission and several meetings with the Community Development Committee in which various implementation measures were approved towards implementation of design elements in the Downtown area. This included the creation of a sign overlay district. Staff is still working on the overlay district details. The merchants dilemma comes in the form of both thett,�e'it takes to process an entitlement application, ( such as CUP, CPD or modification to such) plus the icorstb-involved with the application. pjrl6aug90 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 This interest was discussed with the Community Development Committee at a recent meeting, The idea of providing an interim regulatory process was considered by the Committee. . Staff is suggesting that the Council consider a six (6) month temporary use permit for various accessory uses in the Downtown area, until a permanent process is put into place. At the end of the six (6) month trial period, staff will analyze the effectiveness of such a program. The types of uses contemplated with a temporary use is as follows: 1. Outside eating 2. Live entertainment 3. Outside produce sales 4. Outside cooking There may be others, but only the above have come to Staff's attention. Such temporary use permits should only be valid for six (6) months. This method would allow the City to accomplish two elements. First, it would provide a more streamlined approach to an approval process with only the cost of a zone clearance ($28.00). Second, it would allow the City to determine if such an activity was in any way a problem as it relates to adjacent uses. Staff may spend more time with these requests than a typical zone clearance. However, if successful, the City will receive increased sales tax dollars and help revitalize the Downtown area. Typically, temporary uses are regulated by conditions. It would be Staff's intent to impose appropriate conditions to reduce or eliminate problems between land uses. Staff Recommendation 1. Direct staff to issue temporary use permits, valid for only six (6) months, to existing uses in the proposed Downtown overlay zone area which provide goods or services that promote the Downtown area. Such temporary uses to be limited to those specified by City Council, such as those identified in this report: 2. Direct staff to report back to the City Council with an analysis of the effectiveness of such a program no later than April 1991.
