Lindley, Assistant to the City ManagerYYYY \ \ \\ DATE: April 6, 1992 (City Council Meeting 4/15) SUBJECT: Consider Second Amendment to the Memorandum of Understanding Between the County of Ventura and the Cities of Moorpark, Simi Valley , and Thousand Oaks. Summary The City of Moorpark, along with the cities of Simi Valley and Thousand Oaks entered into a Memorandum of Understanding (MOU) for the coordinated preparation of the Source Reduction and Recycling Elements (SRRE) in the east County. The total cost figures for the preparation of the Elements has been revised and the County of Ventura Solid Waste Management Department is requesting that the County and the cities of Moorpark, Simi Valley, and Thousand Oaks approve the second amendment to the MOU. Background In May, 1990, the Council approved the MOU with the County for the preparation of the City's SRRE. The MOU was scheduled to terminate on June 30, 1991. A $1.45 /ton tipping fee surcharge was implemented at Simi Valley Landfill to cover the County's and the cities' costs of preparing the SRREs. The budget set for the completion of the documents was $500,000 which included payments to each jurisdiction of $50,000 in revenue from the landfill surcharge for staff costs. The surcharge was scheduled to terminate with the MOU. At the request of the County, the Council took action to amended the MOU on June 13, 1991, to reflect several legislative changes. The passage of AB 2707 required the preparation of Household Hazardous Waste Elements (HHWE) as a separate plan and AB 1820 PAUL W. LAWRASON JR. JOHN E. WOZNIAK SCOTT MONTGOMERY BERNARDO M. Mayor Mayor Pro Tern Councilmember Councilmember Councilmember Amend Memorandum of Understanding April 6, 1992 Page 2 allowed for a December 1991 submittal date for SRREs if an environmental impact report is prepared. The MOU was revised to include the HHWE preparation and extend the submittal date and landfill surcharge to December 31, 1991 to cover any additional costs. Now that the cities' SRREs have been completed and submitted to the County in accordance with AB 939, the Solid Waste Management Department has finalized its costs of preparing the cities documents. Each jurisdiction has received $50,000 for staff costs as stated in the MOU. To incorporate the new legislative changes, i.e., preparing a separate HHWE, the County incurred an additional $48,140 in expenses. Sufficient revenues were generated from the landfill fee surcharge extension, previously approved by the jurisdictions, to cover the additional expenditures. The remaining net revenue of $8,448 collected from the surcharge will be distributed to the participating jurisdictions in accordance with the MOU. Moorpark's percentage of the remaining net revenue is 10% or $844.80. Recommendation Staff recommends that the City Council approve the second amendment to the Memorandum of Understanding between the County of Ventura &nd- the cities of Moorpark, Simi Valley, and Thousand Oaks, increasing the SRRE preparation budget $48,140.
