Richards, Director of Community Development B� [ fa..—..„ DATE: April 21, 1992 (CC meeting 5/6/92) SUBJECT: PD 980 Minor Modification No. 6 (Carlson) BACKGROUND Planned Development Permit No. 980 was approved by the City Council (Resolution No. 84-63) on January 18, 1984 for the construction of a 125,113 sq. ft. shopping center. DISCUSSION This request for a Minor Modification consists of two parts: to legalize three tables which have already been placed outside Flamingo's Frozen Yogurt, and to place two water vending machines in front of Hughes Market, Three tables and twelve chairs have been placed in front of Flamingo's Frozen Yogurt (223 W. Los Angeles Ave.) These tables and chairs are white in color and two of the three tables have umbrellas. None of the tables impede the opening of the front door. The walkway area between the tables and the building is 5'5" and between the two front tables (providing access from the parking lot) is 6'. This is adequate for pedestrian access. Although the placement of these tables requires an additional 4 parking spaces, a sufficient number of extra spaces exist in the center to accommodate the additional spaces required by the tables. The proposed water vending machines will be located in front of Hughes Market (101 W. Los Angeles Ave) and are owned and operated by the Glacier Water Co. These machines are 6'9" in height, 3'6" in width, 2'9"in depth and are blue and white in color. Sidewalk width is 11'1", and would be reduced to 8'6" in width after the machines are installed. This leaves an adequate amount of space for pedestrians even when the machines are in use. In order to ensure that the machines match the design of the center (to avoid appearing as though the machines were placed on the sidewalk and not an integral part of the design) a condition will be required that the machines be screened on the tops and sides. These screens must match the material and color of the existing building. Approval of the screening design from the Community Development Department must be obtained prior to Zoning Clearance approval for installation of the machines. The Director of Community Development intends to condition this request for a Minor Modification to require that: 1) This permit covers installation of two water vending machines only, any other machines will require approval of an additional Minor Modification. 2) Adequate pedestrian space (a minimum of five feet) must exist on at least one side of the machine and tables. 3) A Zoning Clearance and Building Permit is required to install the water vending machine. 4) All machines must be screened on the top and sides. The design of the screening must be approved by the Community Development Department prior to final approval of the Minor Modification. PAUL W. LAWRASON JR. Mayor Mayor Pro Tem Councilmember Councilmember Councilmember Printed On Recycled Paper 5) All chairs and umbrellas for the tables must be stored inside the Yogurt store overnight. 6) That no more than three (3) tables and twelve (12) chairs may be established directly in front of the Yogurt store. 7) That should there be a discontinuance of food sales from the yogurt tenant the use of outside tables and chairs shall be discontinued. Should the use at the Yogurt store be discontinued, the use of outside eating for the same number of tables and chairs may be transferred within the area regulated by PD 980 with the approval of a Zoning Clearance. This proposal has been reviewed by the Director of Community Development, who intends to approve it with the included conditions on Nay 5, 1992, with the appeal period ending May 15, 1992. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, a public hearing should be scheduled. The next available hearing date is June 3, 1992. If the Council takes no action, then the Director's decision stands.
