SUBJECT: DP 176 Minor Modification No. 1 (Bend Pak)
BACKGROUND
Development Plan No. 176 was approved by the County of Ventura on
February 17 , 1977 for the construction of three 20 ,400 sq.ft.
industrial buildings. Only one of the three buildings was
constructed.
At the time of approval the site was zoned M-2. M-2 zoning allowed
outside storage as a permitted use. In 1984 , the site was rezoned
to M-1 which does not permit outside storage unless approved as
part of the IPD. When this matter was addressed by the City, the
position was taken that since the original Development Plan did not
indicate outside storage on the approved site plan, it could not
take place without approval of a Modification to the permit.
DISCUSSION
This request for a Minor Modification is for 4 ,700 sq.ft. of
outside area to be used for storage (8.5% of the site area) , and is
being filed in conjunction with Section 8109-4 . 2. 2 of the Zoning
Code which states "Predominant activities and operations shall be
enclosed within buildings, except as otherwise provided in this
chapter. The Planning Director is authorized to determine the
reasonable application of this provision in cases of operation
hardship or other showing of special circumstances. "
Outside storage is proposed to be located on the south and west
sides of the building. The proposed storage area on the west side
of the building is located in the north side of the parking lot.
Section 8109-4 . 2 . 5 of the Zoning Code states "Accessory outside
storage shall be confined to the area to the rear of the principal

building or the rear two-thirds of the property, whichever is the
more restrictive, and screened from view from any property line by
appropriate walls , fencing, earth mounds or landscaping." Because
this use was initiated while the property was zoned M-2, outside
storage in the proposed location is allowed.
Approval of the outside storage areas will reduce the number of
parking spaces provided to 41 from the 43 spaces originally
provided by DP 176. The proposed number of parking spaces meets the
previous as well as the current Zoning Code requirements. These
storage areas will not reduce in size any of the existing
landscaped areas, which will remain at 10.3% of the site.
The Director of Community Development intends to condition this
request for a Minor Modification to require that:
1) Loading and unloading operations be moved to the north
half of the subject property, a shown on the site plan dated
December 17, 1991.
2) Enclose the air compressor located immediately adjacent to
the south end of the building so that it does not exceed a 65
dba level measured at the property line.
3) Replace, as part of the normal maintenance, the cart
wheels which are now steel , with phenolic surfaced material.
Total replacement for all carts shall be accomplished by June
30, 1993.
4) All manufacturing activities of any kind be restricted to
the inside of the structure.
5) All overhead doors be kept closed, except during actual
loading and unloading operations.
6) Loading time shall be scheduled to restrict loading on the
dock so that it occurs Monday through Friday between 7:00 a.m.
and 5:00 p.m. only. No loading to occur on Saturday or
Sunday. No loading to occur in the street on Flinn Avenue or
Minor Street.
7) That the outside storage area shall be restricted to those
two areas shown on the site plan dated December 17, 1991 (a
total of 4,700 sq.ft. ) . Outside storage of material shall

remain below the height of the existing property line wall at
all times.
8) Outside storage shall not be visible from the first floor
of the residential property to the south.
9) Noise levels at the property line shall not exceed 65
decibels.
This proposal has been reviewed by the Director of Community
Development, who intends to approve it with the included conditions
on May 5, 1992, with the appeal period ending May 15, 1992.
Pursuant to Resolution No. 88-523 the Director has the authority to
approve Minor Modifications. This matter is being presented to the
Council as a courtesy. Should the Council, or any other party,
desire to appeal the Director's decision, a public hearing should
be scheduled. The next available hearing date is June 3, 1992. If
the Council takes no action, then the Director's decision stands.

Noise Study
Gentlemen:
At your request we have made a noise study of the Bend-Pak plant located at
646 Flinn Avenue, Moorpark, California. This letter details the results of those
measurements.
. Sound pressure level measurements were made on two separate days at the
same location. This location is immediately adjacent to the Bend-Pak plant to
the south in the parking lot of the adjacent residential development, This was
judged to be the worse-case location adjacent to the plant. The location is
approximately 20 feet from the block wall which separates the two properties
and approximately 55 feet from the nearest structure to the south. Levels at the
actual structures due to the noise at the Bend-Pak plant will be lower than
those measured at this location.
The first measurements were taken on September 10, 1991. The major sources
of noise generated by the Bend-Pak operation included back-up beeps on
vehicles, dropping of steel, the dragging of chains, an unenclosed compressor.
and the rolling of carts. In addition to these sources there were other sources
generated by background traffic in the area, passing cars on the nearby streets
and overflights by general aviation aircraft. A car passing in the driveway
made an overall noise level of 66 dBA and was not included in the survey.
The overall Lel noise level from all these sources combined including
background level was 54.6 dBA Leg. This is lower by approximately 10 dB
than the Moorpark noise ordinance which requires that noise levels be less than
65 dB Lam.

While the measurements indicated that the plant was in compliance, some
recommendations were made to reduce the noise levels in order to be a good
neighbor.
• The following recommendations were made:
1. Move the load and unload operations to the north half of the property.
2. Enclose the air compressor located immediately adjacent to the south
end of the building.
3. Replace, as part of the normal maintenance, the cart wheels which are
now steel with a phenolic surfaced material.
4. Restrict manufacturing activities to the interior of the structure.
5. Keep all overhead doors closed, except for loading and unloading
operations.
These recommendations were carried out, except for completion of the cart
wheels which is on-going.
A second set of measurements were taken on December 13, 1991. Here the
background traffic was increased over the previous time and a train went by
during the measurement period. The results were an overall Leg level of 55.0
which is quite close to the previous level. The overall contribution due to the
plant, however, had been reduced. During the measurement period a trash
truck entered the lot and picked up a Ioad of trash (max 64 dBA). The railroad
train went by resulting in a noise level of between 52 to 54 dBA. The
compressor which has been enclosed was reduced to an overall level of
48 dBA. A car passing in the driveway of the parking lot of the residential
property resulted in a peak level of 70 dBA (not included).

The overall results of the measurement indicate that the plant was in
compliance with the noise ordinance before these measures were undertaken
and is still in compliance. The annoyance due to unloading operations should
be less due to the movement of these operations away from the residential
property line. The compressor on the Bend-Pak plant is barely audible now,
and the wheel generated noise is much reduced in those carts which have been
treated.

In compliance with your letter of March 23, 1992 requesting the
filing of a minor modification, find the following enclosed:
1. one application form;
2. a $314 application fee per your letter;
3. fee reimbursement agreement;
4. 2 plot plans folded 8k x 11 (the plan .dated December
17, 1991 showing a total of 4,700 square feet of
outside storage, per your request) ;
5. one 81 acetate reduction of the requested plot plan;
and
6. one additional copy of the noise study, previously
filed with your office January 6, 1992.
In addition, Bend-Pak is in agreement with the 7 limitations
outlined in your letter. We look forward to concluding this
