Richards, Director of Community Developmen DATE: April 17, 1992 (CC Meeting 5-6-92) SUBJECT: STATUS REPORT REGARDING UNREINFORCED MASONRY BUILDINGS IN THE CITY AND A REQUEST TO ISSUE A NOTICE OF NON COMPLIANCE TO ONE PROPERTY OWNER AFFECTED BY THE CITY'S URM ORDINANCE BACKGROUND On August 1, 1990 the City Council adopted Ordinance 127 relating to earthquake hazard reduction in certain existing buildings (unreinforced masonry) . This action was in response to the passage of SB547 which required the City to establish an unreinforced masonry mitigation program. A survey was conducted by the City and only seven ( 7) buildings were identified as being unreinforced masonry. SB547 required the City to accomplish three tasks prior to January 1 , 1990; 1. Identify all URM buildings that are potentially hazardous. 2. Develop and implement a mitigation program to reduce the hazard. 3 . Submit information on potentially hazardous buildings and hazard mitigation programs to the Seismic Safety Commission. On August 14 , 1991 the City Council received a staff report on the status of the Unreinforced Masonry (URM) Mitigation Program. This report indicated that one building owner was apparently unable to comply with the requirements of Ordinance 127 . The City Council directed staff to arrange for the building owner to meet with the Community Development Committee in order to fully understand the difficulties faced by the owners of URM buildings. Mayor Mayor Pro Tem Councilmember Councilmember Councilmember Printed On Recycled Paper On September 16, 1991 the building owner's representative met with the Community Development Committee, Building Official , Community Development Director and several concerned citizens. Subsequently, the Building Official has provided the owner with information on engineering firms and with information on available financial alternatives for URM owners. At the conclusion of the September meeting the building owners representative indicated a willingness to complete the required survey and provide the Building Official with an official reply. The building owners have indicated in the past that the building has been vacated for reasons which are unrelated to the URM ordinance. They have no immediate plans to reoccupy the building. At the January 8 , 1992 City Council meeting this department provided a status report regarding unreinforced masonry building at 450 Charles Street. At this meeting, the Council requested a status report regarding the other six (6) buildings needing to accomplish earthquake upgrades. The following information was received by this office from Building and Safety on March 2 , 1992 : 1 . 601 High Street - All repairs completed. 2 . 609 Walnut Street - All repairs completed. 3 . 255 High Street - Permit issued 1/21/92 . Building is under repair. 4. 105 High Street - Permit issued 2/20/91. No work is underway; permit extension requested and granted to 8/12/92. 5. 45 High Street - Plans were approved 7/11/91. Permit not issued; plan review extension requested and granted to 8/28/92 . 6. 450 Charles Street - Not in compliance with the (Methodist Church) U.R.M. ordinance. 7 . 71-95 High Street - Permit issued 10/23/91. No work is underway. SRP-0A-17-92(9:12ar)A:\CC\6MAY92 2 DISCUSSION Ordinance 127 requires that the Building Official order a building vacated where compliance with the ordinance has not been achieved within the time limits set forth in the ordinance. After ordering a building vacated and where compliance is not achieved within ninety days the Building Official may order the demolition of the building. This ninety day period may be extended by the Council acting as the Board of Appeals. No limit is placed on the length of extensions which may be granted by the Council. Extensions of the ninety day limit should be considered with care and such extensions should not allow the indefinite delay of the repair or demolition of the building. Ordinance 127 requires that buildings which are in violation of the ordinance be ordered vacated. The building at 450 Charles Street has been vacated in any case for unrelated reasons. If the Council takes no action then the Building Official will be directed to issue an order to vacate and will do so during the month of May, 1992. The owners have the right to appeal within 60 days from receipt of notice to vacate. The Building Official will report back to Council in any case before considering any order regarding the demolition of the building. RECOMMENDATION Receive and file this report.
