SUBJECT: DP -304, MINOR MODIFICATION NO. 1 — A REPORT REGARDING A
REQUEST FOR ADDITIONAL FUNDS ABOVE THE INITIAL DEPOSIT
AMOUNT
Background:
Under the City Council's consent calendar of March 25, 1992,
Council approved DP -304, Minor Modification No. 1 to allow the
continued operation of a combined elementary school located at 5239
Commerce Avenue for employees' children.
Case processing for this Minor Modification request totalled
$1,011.75; however, the applicant initially deposited $376.80. In
order to approve this Minor Modification request, the applicant was
required to obtain approvals from the Fire Department and Building
and Safety. In order to bring G.T. Water Products Inc. into
conformance with agency requirements, approvals from these agencies
was forthcoming 1 year and 7 days after the Minor Modification
application was initially filed (3- 18 -91). During this time period,
it was necessary for staff to follow up with both the applicant and
the agencies in order to remain apprised of permit approval status.
Coordination and follow up resulted in costs incurred above the
initial deposit amount.
Under the City's reimbursement agreement, staff is permitted to
collect additional funds up to 75% of the initial deposit, or in
this case $282.60; for a total entitlement case processing of
$659.40. Any cost incurred for case processing above the 75%
deposit amount requires Council's approval to collect the remaining
funds due.
Staff is intending to collect only 75% of the initial deposit or
$282.60 additional from the applicant because of the need for
agency coordination involved.

Dear Ms. Kathleen Mallory Phipps;
RE: DP -304, Minor Modification No. 1
I cannot begin to tell you how upset, I am over your recent
request for funds regarding the above - referenced permit. Your
strong arm tactics are outrageous and totally obnoxious,
especially when you have your citizens over that proverbial
barrel. Put me on the agenda, I would love to speak to the
public and the media telling them how helpful Moorpark is when it
comes to its citizenry. After believing, I was grandfathered
into the code on August 1990, I was faced with paying for a minor
mod. fee of $376.80 in March of 1991. All during the process,
Planning offered little help. The only aid, I received was from
Building and Safety, who could never return my calls because the
city of Moorpark didn't have enough in their budget to pay for
such calls. Hit or miss via phone or visit, David Bard of
Building and Safety was the one who came through for me and
Officer Mertens of the Ventura County Fire Department. By the
way, the fire department did not charge a fee. They are public
servants in the best sense, unlike those of Moorpark, who for
some reason believe the public serves them!
I refuse to pay the $282.60 or $634.95 after expending nearly
$5500.00 to bring the school up to code. Enough is enough, you
have gouged the people of Moorpark at every turn. We are good
neighbors, good citizens and have earnestly tried to better this
community. But your department, with its stack of reports and
complex procedures, is frankly a determent to this city.
Again put me on the agenda and let me speak.
