Kellerman, City Clerk DATE: April 30, 1992 SUBJECT: Consider Request for Amicus Support -City of Rancho Mirage BACKGROUND The City of Rancho Mirage is seeking Amicus support in a case brought against it by the recycling industry. The issue in the case is whether or not cities can franchise or contract for the collection of recyclable materials. The City Attorney has indicated that an adverse decision would allow any and all recyclers to enter the community and "cherry pick" the recyclables. RECOMMENDATION Authorize support of the Amicus Brief in City of Rancho Mirage vs. Palm Springs Recycling Center on the condition that the City incur no cost for the preparation or filing of the Brief.
