On May 20, 1992, the City Council
intent to take the subject actions.
DISCUSSION
A. Report of May 20, 1992
adopted resolutions stating its
The staff report considered by the City Council on May 20, 1992,
included a draft copy of the Engineer's Report and certain other
Exhibits pertaining to assessment district costs. Please refer
to that document for specific details regarding the derivation
of the proposed assessments.
B. Corrections
It is necessary to correct certain errors in the data set forth
in the above mentioned report. Certain Exhibits set forth in
the May 20 staff report should be replaced with or revised by
the following:
Exhibit "A": Revisions to Engineer's Report
Exhibit "B ": Summary of Fund Activity
Exhibit "C": Draft Departmental Budget for FY 1992/93
C. Resolutions
In addition, the following exhibits pertain to the subject
action.

D. Citywide.Assessment
The corrections to the May 20 staff report are reflected in the
following revised assessment comparison for a typical single
family lot:

E. Public Hearing
The "Landscaping and Lighting Act of 1972," as set forth in the
California Streets and Highways Code, requires a public hearing
to receive input and to hear any protests to the proposed
annexation and the proposed levying of assessments. Public
Hearing notices have been published and posted in accordance
with the requirements of the act. In addition, said notices
were mailed to the all of the properties in the City.
F. Deferred Action
The attached resolutions must be adopted no later than June 30,
1992, in order for the assessments to be levied. In prior years
the City Council has adopted such resolutions concurrently with
the adoption of the budget.
Staff recommends that the City Council open the public hearing,
receive testimony and continue these matters to the date of the
Budget Workshops.
Subsequent to the budget workshop meetings, but no later than June
30, 1992, staff recommends that the City Council take the following
actions:
1. Adopt Resolution No. 92- (Exhibit "D ") annexing Home
Acres into Assessment District 84--2.
2. Adopt Resolution No. 92- (Exhibit "E") making certain
changes to AD84 -2 and confirming the assessments for Fiscal
Year 1992/93.

RESOLUTION NO. 92-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, ORDERING THE
ANNEXATION OF CERTAIN PARCELS TO THE "MOORPARK
LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT
84.2" [HOME ACRES]
WHEREAS, on May 20, 1992, the City Council adopted
Resolution No. 92 -850 initiating proceedings and declaring its
intention to annex certain parcels to the "MOORPARK LIGHTING
AND LANDSCAPING ASSESSMENT DISTRICT NO. AD- 84 -211; and,
WHEREAS, the area to be annexed, generally known as Home
Acres, is described as Area "Y" on the Exhibit 1 attached
hereto and made a part hereof.
WHEREAS, the Engineer has prepared a report setting forth
certain findings and recommendations pertaining to said
annexation; and,
-- WHEREAS, said report was approved by the City Council on
May 20, 1992, by adoption of Resolution No. 92 -854; and,
WHEREAS, on May 20, 1992, the City Council adopted
Resolution No. 92 -853 declaring its intention to make certain
changes to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE
ASSESSMENT DISTRICT NO. AD- 84 -2 ", including the aforesaid
annexation; and,
WHEREAS, said resolution set the time and place for a
public hearing to consider said changes; and,
WHEREAS, no written protests to the proposed annexation to
said district, were received by the City Council prior to the
close of the hearing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The annexation of the parcels within that
area identified as Area "Y" on Exhibit 1, to the "MOORPARK
LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO.
AD- 84 -21111 in accordance with the Engineer's Report and
Resolution of Intention No. 92 -850, is hereby ordered.

SECTION 2. The City Clerk shall certify to the adoption
of this resolution.

RESOLUTION NO. 92-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, MAKING CERTAIN
CHANGES TO THE "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT
NO. AD- 84 -211; AND CONFIRMING THE ASSESSMENT
FOR SAID DISTRICT THE FISCAL YEAR COMMENCING
JULY 1, 1992 AND ENDING JUNE 30, 1993.
WHEREAS, the City Council of the City of Moorpark, by
Resolution No. 92 -853, adopted May 20, 1992, declared its
intention to make certain changes to the "MOORPARK LIGHTING
AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2111
and to order the extension of the annual assessments for said
district for the fiscal year commencing July 1, 1992 and
ending June 30, 1993; and,
WHEREAS, said "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" consists of a
single city -wide zone to provide electric current or energy
for public lighting within the City, to provide for
installation or maintenance of landscaping and the
construction or maintenance of curb, gutter, or sidewalk
structures and facilities, to install or construct facilities
which are appurtenant to any of the foregoing, for the
maintenance or servicing or both, of any of the foregoing and
to provide incidental expenses in connection therewith; and,
WHEREAS, on June 3, 1992, the City Council held a public
hearing to determine whether said changes to said district
should be made, and whether the annual assessments should be
ordered and confirmed for the fiscal year commencing July 1,
1992 and ending June 30, 1993; and,
WHEREAS, no written protests to the proposed changes to,
and to the annual assessments proposed to be levied for, said
Assessment District No. 84 -2, were received by the City
Council prior to the close of the hearing; and,
WHEREAS, the City Council determined that it had the
authority to proceed with the - changes to and extension of
annual assessments for the fiscal year commencing July 1, 1992
and ending June 30, 1993.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Engineer's Report for "MOORPARK LIGHTING
AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2 ",
filed May 20, 1992, is hereby approved and adopted, and the
improvements, changes to, and extension of the annual
assessments in the Assessment District, in accordance with
said report and in accordance with Resolution No. 92 -854
approving said Engineer's Report, is hereby levied for the
fiscal year 1992/93.
SECTION 2. The City Clerk shall cause the diagram and
assessment, or a certified copy thereof, to be filed with the
County Auditor.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution.
