Gilbert, Director of Public Works DATE: June 22, 1992 (Council Meeting 7 -1 -92) SUBJECT: Consider Acceptance of a Grant Deed for Property at the Southeast Corner of Condor Drive and Los angeles Avenue [Parcel 'A': Tract 3492] OVERVIEW This presents for approval a Certificate of Acceptance for the subject Grant Deeds. DISCUSSION The subject property at the southeast corner of Condor Drive and Los Angeles Avenue was designed and constructed to be a landscaped entry statement for the Condor Drive Industrial Park. The property was improved and was maintained by the Moorpark Business Center Owners Association ( "Association "). Over a year ago this maintenance effort was terminated. Staff has been working for some time with representatives of the Association to transfer the ownership and maintenance responsibilities for this property to the City. The City is in receipt of a Grant Deed for this purpose. Although the language in the Grant Deed reserves to the Association an easement in gross for the existing sign and landscaping maintenance, the Deed also states that the Association is not obligated to perform such maintenance. Should the Grantor fail to perform this maintenance, be advised that the City would assume this obligation. A Policy of Title Insurance has been ordered and is expected to be provided prior to the July 1 meeting. RECOMMENDATION Staff recommends that the City Council authorize the City Clerk to execute a "Certificate of Acceptance" for the subject deed and forward same to the County for recordation. wp51 \rpt \deed3 PAUL W.
