Lindley, Assistant to the City Manager `:A June 23, 1992 (July 1 Council Meeting) Consider the Ventura County Waste Management Authority Reorganization Proposal The City Council is in receipt of the Waste Management Authority Reorganization Proposal from the Ventura County Waste Commission. The Commission is requesting the Council's formal concurrence with the Proposal; final approvals are expected to occur this Fall following completion of the draft legislation. Council is also being asked to adopt the attached Resolution which expresses the City's commitment to joining the Waste Authority upon its formation through State legislation. Background On November 21, 1991, the Waste Commission released its Draft Reorganization Proposal to the Cities and the County for their review and comment. Since then the jurisdictions have had an opportunity to respond with comments on the proposal. Several study sessions involving elected officials and the City Managers have been held to resolve major outstanding issues raised by the local governments. The areas of concern specifically addressed and resolved at the study sessions included waste and recyclable collection; land use and siting; rate setting; profit sharing; property tax redistribution; timing and funding of management and organization studies for the new Authority; special vote requirements; local AB 939 planning authorities; withdrawal or detachment; flow control; compelling need determinations; special assessments; and liability and risk allocation. Following the study sessions, the Proposal was revised to reflect the agreed -upon changes and they were included in the final Draft that Council has previously received. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Waste Authority Reorganization Proposal June 23, 1992 Page 2 Of major concern to the City of Moorpark was 'the issue of liability. The original proposal recommended that liability be allocated on a wasteshed basis for the first five years, then systemwide thereafter. Councilmember Montgomery, representing the City on the Waste Commission, and other east county representatives were successful in revising the distribution of liability on a more equitable basis of wasteshed indefinitely. Moorpark and the other eastern county cities will not share in the liability for western county facilities. As it stands, the Reorganization Proposal creates a Waste Management Authority which is empowered to act as a public utility for the provision of solid waste services. To this end, the California State Legislature will be asked to transfer specific powers and authorities relevant to solid waste management from local governments to the Authority. In essence, the three existing solid waste agencies - Ventura County Solid Waste Management Department, Ventura Regional Sanitation District, and the Ventura County Waste Commission - will be merged into a single independent Waste Authority responsible for the county waste management system. The Waste Commission including Moorpark's representative, Councilmember Montgomery, has approved the reorganization proposal in concept and is requesting that the cities and County consider approval as well. Approval in concept does not commit the City's waste flow to the Waste Authority. Council will have an additional opportunity to review the Proposal for final approval following the completion of the consultant studies and draft legislation. At that time each jurisdiction would agree to waste flow commitments. The current time -line calls for introduction of urgency legislation to the State Legislature in January 1993 and formation of the proposed Authority in July 1993. A standard Resolution has been prepared which indicates a jurisdiction's conceptual approval and commitment to join the Waste Authority when state legislation authorizes its creation. It is hoped that this resolution will speed up the formation of the Authority. Recommendation Staff recommends that the Council approve the Ventura County Waste Management Authority Reorganization Proposal in concept and adopt the attached Resolution.
