FROM: DIRK LOVETT, ASSISTANT CITY ENGINEER< DATE: JULY 15, 1992 , 0 By SUBJECT: RPD 89 -3 (Presbyterian Church) EXONERATION OF GRADING BOND (Great Western Bank C.D.# 080- 691008-8) BACKGROUND: RPD 89 -3 (Presbyterian Church) is located at the Southeast corner of Spring Td. and Peach Hill Rd. Grading for this church began in June of 1991. All grading has been supervised and has passed final inspection with the exception of final landscaping. Landscaping is scheduled to be completed in October. The Church has requested the exoneration of this $40,000 bond (formal request and current bank statement attached). The Bond amount of $40,000 included estimated slope landscaping costs of $2,600. It is therefore appropriate to accept grading as complete and reduce the bond to $6,340 for the one year guarantee period. The retention includes the entire amount of $2,600 estimated for slope landscaping plus $3,740 (or 10 %) of the ($37,400) grading estimate. Total retention is to be $6,340. RECOMMENDATION: 1. Accept slope grading for RPD 89 -3 as complete, with the exception of landscaping and 100 of the grading estimate. 2. Authorize the City Clerk to reduce the aforementioned bond to $6,340 upon receipt of a letter of amendment from the Great Western Bank including "slope landscaping" as a part of the grading bond. co: CC BOND EX CD #080 - 691008 -8 Attachment PAUL W. Box 1007, Moorpark, CA 93021 0• V V s June 24, 1992 r U S NN Dear Mr. Phelps, This is to follow up on our conversation regarding the project at Moorpark Presbyterian Church. We requested three things: i. Issuance of a temporary or interim occupancy permit (probably around July 13) for the completion of the project with the exception of landscaping. We plan to complete landscaping by mid - October using volunteers with priority given to the exposed slopes along Spring. When landscaping is completed we will request the final permit. 2. A letter from the City authorizing immediate release of our grading bond. The bond's purpose was to insure that grading would proceed to the full project. This has been accomplished. The "punch list" received ties in with such things as the completion of landscaping (see item 1) and "replacing a blue reflector" which would probably be broken by equipment moving to the new middle school site and the future Carlsburg Development. It would seem that such items should be tied to the occupancy permit and not the grading bond -- especially since Carlsburg (see Lloyd Laycook) accepts the majority of items on our punch list as being their responsibility. We need this $40,000 bond to be released so we can pay our contractor. 3. For you to communicate with the person responsible for approving the landscaping plan requesting him or her to accommodate the plans of the "Moorpark Beautiful" committee as far ^as tree types and sizes. Moorpark Beautiful has stated a desire to donate but do not have access to the types and or sizes of trees previously specified. We will be coming to you very soon with specific design and plans for the modular buildings approved by the City. The design will be similar to that previously shown to the City (similar to the existing units at the Foursquare Church) with architectural "tieing together" being accomplished through trim paint that will match the teal trim on the Fellowship Hall. This will allow us to secure the modulars in light of the rigid budget as established for us on this part of our project by the Presbytery of Santa Barbara.
