SUBJECT: GENERAL PLAN UPDATE IMPLEMENTATION
Background
Staff has completed the City Council requested revisions to the
Land Use and Circulation Elements. The large -scale map originals
have been sent to a graphics company to have reductions made for
inserting in the final Land Use and Circulation Elements. We
expect to be able to send the Land Use and Circulation Elements to
a printer for final reproduction work next week.
Staff now must proceed with implementation of the Land Use and
Circulation Elements. The initiation of work on preparation of
specific plans and submittal of a sphere of influence amendment
application to LAFCO are objectives for Fiscal Year 1992 -93. These
two implementation items are discussed below. Also included in
this report is a suggestion regarding financing continued staff
work for General Plan update implementation. Staff is preparing a
work program which addresses work tasks required by the adopted
Land Use and Circulation Elements and the mitigation monitoring
program. This work program will be provided to the Council under
separate cover.
Discussion
Specific Plan Processing
The Community Development Committee held several meetings in June
and July to discuss processing options for the specific plans
identified on the Land Use Plan approved in May. The Committee's
recommendations are discussed below.
The Community Development Committee and staff recommend that the
following procedures be followed in the processing of specific
plans:
1. All specific plan applications received can begin to be
processed concurrently by staff. No specific plan will be
given priority; however, based upon the unique requirements,
size, etc., of each specific plan, we would expect that these
plans would come to hearing at different times.

2. City staff will prepare detailed specific plan and
environmental document requirements including content and
processing procedures (as determined appropriate for a
specific plan application).
3. The City will hire a private consultant to prepare a specific
plan and the required environmental document (probably an
environmental impact report) . The developer would be required
to fund all of the consultant costs as well as staff costs to
process the specific plan and environmental document.
4. The developer, City staff, and the public would be involved in
the specific plan preparation process.
The developer would be allowed to submit an initial land
use plan proposal and other project details required for
preparation of the specific plan.
One or more public workshops for each specific plan would
be held after consultant selection to solicit public
comments on the land use plan for each individual
specific plan area. Residents within 1,000 feet of the
specific plan area would receive detailed notice of any
workshops. Workshops would be conducted by staff with
participation by the developer and the consultant(s) for
the specific plan and EIR.
5. The City Council would be given the opportunity to concur with
the alternatives selected for analysis in the EIR. At a
minimum, alternatives which will be analyzed shall include the
maximum density permitted, the density limit, and an
alternative which mitigates all identified significant
environmental impacts.
Sphere of Influence Amendment Application
Staff has discussed submittal of a sphere of influence amendment
application for the Specific Plan No. 8 area with Stan Eisner, the
LAFCO Executive Officer. He has suggested that the City proceed
with submitting the application and pay the required fee. He will
then review the environmental impact report prepared for the
General Plan Update to determine whether that EIR contains all
information necessary for LAFCO's use. Prior to staff proceeding
with the filing of a sphere of influence amendment application for
the Specific Plan No. 8 area, the following should be required: 1)
one or more of the Specific Plan No. 8 property owners shall enter
into an agreement to pay for all staff costs to process the sphere
of influence amendment application; and 2) One or more of the
Specific Plan No. 8 property owners shall pay a fee equal to the
Council's determination of a fair -share of the total General Plan

Update processing costs. Staff is recommending that a separate
report regarding the filing of a sphere of influence amendment
application be prepared for the Council's August 19, 1992, meeting.
Staff will discuss a recommended fair -share fee in that report.
Financing -.for General Plan Update Implementation
To help fund those costs needed to proceed with the processing of
the specific plans, but which may not be attributable to any one
individual specific plan, the Community Development Committee and
staff recommend the collection of a non - refundable fee in the
amount of $50.00 per dwelling unit, based on the maximum dwelling
units shown in the Land Use Element for each specific plan. This
fee will pay for City staff and /or any consultant costs to ensure
that preparation work to allow processing of the specific plans is
completed. For example, some of the General Plan Update
implementation measures, such as a transportation improvement fee
program and a hillside protection ordinance, should be adopted
prior to specific plan approval. Staff recommends that this fee be
paid by August 10, 1992. Those specific property owners that
choose not to proceed at this time should be required to wait at
least 6 months before they could again be considered for
processing.
Recommendation
1. Review and comment on the proposed specific plan processing
procedures.
2. Direct staff to prepare draft specific plan and EIR
requirements and submit for City Council review and comment by
August 19, 1992.
3. Direct staff to begin informal contacts with private
consultants to develop a list of qualified firms for
preparation of specific plans and EIR's.
3. Direct staff to accept specific plan applications, but require
an initial fee equal to $50 per dwelling unit, based on the
specific-_plan's maximum dwelling units. This fee shall be
paid by August 10, 1992, or a specific plan developer shall be
required to wait for a period of time, as determined by the
City Council, to be included in the next window of opportunity
for filing a specific plan application.
4. Direct staff to prepare a report for the Council's August 19,
1992, meeting regarding the filing of a sphere of influence
amendment application with LAFCO for the Specific Plan No. 8
area.

RE: Agenda Item IIC. Consider General Plan Update Implementation
Thank you for the opportunity to comment on the General Plan Update
Implementation process. In reviewing the staff report for this
agenda item,.I found several of the recommendations disturbing --
the most significant of which is the recommendation for financing
the General Plan Implementation.
In our opinion, the recommendation to charge specific plan
applications a $50 per unit, non- refundable fee, based on the
maximum dwelling units allowable, to cover the remaining cost of
General Plan implementation measure is at the very least a blatant
disregard for the proper notification procedure for establishing
fees through the Public Hearing process. In addition, it
inappropriately places the burden of General Plan cost overruns on
one segment of the development community.
It is our understanding that the City is responsible for updating
the General Plan and as such is responsible for financing that
activity. We feel it is inappropriate to expect those projects
within Specific Plan areas to contribute a fee over and above their
individual processing costs. And, we believe it is inappropriate to
base a fee on maximum level of dwelling units without allowing for
refund if, in fact, a lower number of dwelling units is approved.
Further, to effectively set a moratorium on processing specific
plans for those projects that do not pay prior to the recommended
August 10 deadline seems rather harsh.

As a representative of the building industry, I feel we have shown
a good faith effort to work with the City of Moorpark to provide
for the needs of the community. As such, I am disappointed that
staff would recommend that the development community pay to help
implement measures, such as the transportation improvement fee
program and a hillside protection ordinance, that will increase our
costs and limit our ability to develop projects. I further
disagree that these implementation measures (as they are
discretionary and not mandatory), must be in place before any
specific plan can be processed.
Both as an industry and as a member of the local business
community, we are struggling to survive under the strain of the
current economy. We look to the City to facilitate our efforts to
remain viable contributors in the community. We need your
leadership and assistance in finding new creative funding programs,
and we need your help in instituting a more appropriate time to
collect fees so that we can work within the tight constraints of
new construction financing requirements. Measures, such as the one
before you this evening, do just the opposite.
We thank you for allowing us to express our concerns, and we
repectfully request you deny this implementation measure as
presented in the staff report.
