Discussion: The requested Minor Modification is for the construction of three model homes prior to Final Map recordation. This request requires a modification of Tract Map condition of approval number 5, which specifies that, "no Zoning Clearance shall be issued for residential construction until the final map has been recorded..." The proposed models will be located in a 6 -Plex style building. This building will have two A units (one bedroom) , two B units (two bedrooms), and two C units (two bedrooms and a den). However, of these six units one A, B, and C unit will be built for model use; a total of three model buildings will be constructed. Color schemes shall not change from that which was approved by the Council. Construction of the model homes will take approximately 8 months; thus this modification will allow model construction to begin and the project to proceed in an expeditious manner. Urban West Communities shall place a bond with the City in the amount of $15,000.00 ensuring that all of the model home sites will be converted to multi- family dwelling units no later than at the time of sale of the last units in Tract 4792. Urban West Communities shall remove all temporary sales offices, landscaping in streets, trap fencing, and signage for the Tract 4792 Model Home Complex in order to restore the site to multi- family dwelling use. 2. Urban West Communities shall place a bond with the City in the amount of $255,974.50 guaranteeing construction of all recreational areas (common area bond). The recreational improvements shall be in place in accordance with the Council approved phasing plan. 3. Colors shall be consistent with the approved color and materials board for Tract 4792. 4. Urban West Communities will assume all risk and responsibility in the event that the Final Map does not record within three years. Within 60 days of approval of this Minor Modification should recordation of the Final Map not occur, Urban West -- Communities shall place a bond with the City for possible demolition and removal of model units. The amount of the bond shall be $100,000.00 to be exonerated when the Final Map is recorded. If the bond is not paid within 60 days of the Council approval of the Minor Modification, the Zone Clearance for construction of the model homes shall be revoked. 5. Urban West Communities shall be required to comply with all other conditions of approval associated with Tract 4792 and Residential Planned Development 91 -2. This proposal has been reviewed by the Director of Community Development who intends to approve the request on August 14, 1992, with the appeal period ending on August 29, 1992. Pursuant to Resolution Number 88 -523, the Director has the authority to approve Minor Modifications. This matter is being presented to the City Council as a courtesy. Should the Council or any other party desire to appeal the Director's decision, a public hearing should be scheduled. The next available hearing date is September 19, 1992. If the Council takes no action, then the Director's decision stands.
