Rubin, Management Analyst X DATE: September 3, 1992 (9/16 Council Meeting) (805) 529 -6864 MOORPAPK, CA­­" City C^ cf- / by SUBJECT: Amend Temporary Commercial Refuse Collection Permit Requirements and Processing Procedures Background The City has a non - exclusive temporary commercial refuse collection permit available to any refuse hauler for collection service provided on a non - regularly scheduled, and less than weekly basis - such as for construction, demolition, and land clearing projects. A refuse hauler must apply for a permit prior to providing temporary commercial refuse collection service, and pay a fee of $500 or prorated (monthly) amount for the one year permit period effective October 1 through September 30. Permits are awarded by the City Council to applicants meeting all of the agreement terms. Significant requirements are listed below: Payment of a $500 fee, or prorated amount to the City upon execution of the permit agreement; Ten (10) percent franchise fee due to ithe City on gross receipts (including landfill costs), payable to the City quarterly; A Blanket Encroachment Permit for the term of the agreement, and regular notification to the City of service dates and location; Establishment of a recycling program for material from temporary bins, including items such as concrete, asphalt, wood and green waste; Provision of necessary information to the City for meeting AB 939 diversion goals Recently, there were three occasions where the City was informed that a non - permitted hauler was providing temporary service. As soon as staff was made aware of the collection activities, the haulers were notified to discontinue temporary collection immediately, or formally indicate PAUL W. LAWRASON JR. JOHN E. On one occasion the hauler (Rubbish Control) requested and was awarded a temporary commercial permit. The other two haulers removed their bins, and the city had to forego revenue. Staff recognizes the need to develop timely processing procedures to capture revenue in such cases when the City becomes aware that a non - permitted hauler provides temporary collection service. Because of such instances where it is untimely for the City Council to approve a permit, staff proposes that the procedures for issuing the permits be amended to allow the City Manager to issue all permits to haulers meeting the permit requirements. Staff will present a report to the City Council regarding permit requests and renewals once a year, prior to the start of the permit cycle (October 1). Furthermore, a new requirement of the Temporary Commercial Refuse Collection Permit needs to be added to reflect recent Council action. At the June 3rd Council meeting, Council approved implementation of a Solid Waste Management\ AB 939 fee. The fee (8% for temporary commercial service) was scheduled for implementation on September 1, 1992, to correspond with the regular refuse billing cycles. This item needs to be added to the current permit requirements. Additionally, the Public Works and Facilities Committee and Staff recommend a revision to the existing requirement that states, "Payment of a $500 fee, or prorated amount to the City upon execution of the permit agreement." The Public Works and Facilities Committee and Staff recommend that the permit fee remain at $500, when received by the date of the new permit cycle, October 1st. However, to encourage haulers to apply for a permit by the new cycle, the prorated fee will be based on an increased permit fee amount of $600. The $600 permit fee allows for an even prorated monthly calculation, and may; discourage haulers from waiting until mid -year to apply for a permit. Staff has directed correspondence to the City's Building and Safety Office, Moorpark City College, and Moorpark Unified School District, informing them of the temporary commercial refuse collection permit requirements, and further requesting the information to be relayed to contractors necessitating the use of temporary refuse collection services. Staff presented this item to the Public Works and Facilities Committee on August 31, 1992, and received their concurrence. Recommendation The Public Works and Facilities Committee (Councilmembers Montgomery and Wozniak) and Staff recommend that Council amend the Temporary Commercial Refuse Collection Permit requirements and processing procedures as outlined in this report.
