On March 29 , 1991, the applicant submitted an application for a Major Modification request for CPD 89-1 and -2 to construct and operate a 265,940 sq. ft. food/retail/commercial shopping center ( including 221 ,440 sq. ft. of general retail uses, 24,000 sq. ft. of restaurants, a 2, 300 sq. ft. gasoline service station, 9,000 sq. ft. of medical/dental office and 9, 200 sq. ft. outdoor plant nursery) and Tentative Tract Map No. 4757 for a division of two existing parcels into thirteen parcels of land (totalling 23.62 net acres) . The tract map was in addition to the existing approved land division map (LDM 89-2 , four parcels) . The City Council approved the tentative tract map and Major Modification on October 2 , 1991. On May 7 , 1992 , the Director of Community Development approved Minor Modification No. 1 for: 1 . Addition of twenty seven ( 27) temporary parking spaces behind the proposed K-Mart building, create thirteen ( 13) permanent parking spaces east of K-Mart along Park Lane, and temporary truck access through a main entrance from Los Angeles Avenue through the parking lot along approximately a twenty two (22) foot temporary westerly drive-aisle and contiguous to the K-Mart building (see Exhibit No. 1) . 2 . Modification of parking configuration from sixty (60) degree parking to ninety (90) degree parking (see Exhibit No. 1) . 3 . Clarify and/or modify the following conditions to Commercial Planned Development Permit Nos. 89-1 and -2 (20, 25, 82 , 86 , 92 , 94, and 110) , Tentative Tract Map No. 4757 condition Nos.28 , 37 to read as follows: PP09.29:91/10:01aMA:\MINMOO].CC 1 PAUL W.LAWRASON JR. Mayor Mayor Pro Tern Councilmember Councilmember Councilmember Printed On Recycled Paper As an option in place of the Surety Performance Bond requirement, the applicant or his successors for Phase II and Phase III will be allowed to record the parcel map (LDM 89-2) if the applicant or successor of Phase II and III agrees to have a subordinate lien to the benefit of the City of Moorpark placed on the subject property and agrees to execute a Reciprocal Access and Parking Easement Agreement and Sideyard Agreement acceptable to the Building Official and Director of Community Development between CPD 89-1 and CPD 89-2 , prior to the issuance of a Zoning Clearance for CPD 89-1 (Phase II) 4 . Delete the first sentence of the City Engineer's Condition of Approval No. 100 to CPD 89-1 and -2 so that the condition reads as follows: (REVISED - condition No. 100 to cpd 89-1 and - 2) As an option in place of the Surety Performance Bond requirement, the applicant or his successors for Phase II and Phase III will be allowed to record the parcel map (LDM 89-2) if the applicant or successor of Phase II and III agrees to have a subordinate lien to the benefit of the City of Moorpark placed on the subject property and agrees to execute a Reciprocal Access and Parking Easement Agreement and Sideyard Agreement acceptable to the City Engineer and Director of Community Development between CPD 89-1 and CPD 89-2 , prior to the issuance of a Zoning Clearance for CPD 89-1 (Phase II) 5. Exclude the following requirements for Ventura Pacific Capital Company (CPD 89-2) until proper documentation described above has been executed: a. Any improvements to CPD 89-1 ; b. Any maintenance requirements on CPD 89-1; c. City Conditions of Approval that would require for the compliance of a Reciprocal Access and Parking Easement Agreement as a prerequisite for building permits or occupancy for CPD 89-2 . Since the applicant was able to reach an agreement with the property owner of CPD 89-1 (Ken Macleod) , the above conditions are no longer valid as Ventura Pacific Capital Group VI will be developing the eastern portion of the shopping center pursuant to the plan approved with Major Modification No. 1 to CPD 89-1 and -2. PP09:29:90/10:01aI\:\MSMMOD3.CC 2 Discussion On September 24 , 1992, Ventura Pacific Capital Group VI applied for Minor Modification No. 3 to Commercial Planned Development Permit 89-2. The Modification is for approval of a revision to the elevations to Shop 4 - which would remove the central towers. In addition, the applicant is requesting clarification of Condition No. 19 (a) of the approved Commercial Planned Development and requesting the addition of a monument sign on Park Lane and one on Los Angeles Avenue. The existing approved Condition of Approval for CPD 89-1 and -2 reads as follows: 19. Prior to the issuance of a Zoning Clearance, a comprehensive sign program for the shopping center shall be submitted to the Department of Community Development. The sign program shall be designed to provide a uniform sign arrangement and design. Only individual channel letters shall be allowed. No lighted window signs will be allowed. The sign program shall be approved by the Director of Community Development or his designee prior to the issuance of a Zoning Clearance. All new lessees shall conform to the approved sign program and be required to obtain a sign permit from the Community Development Department. Monument signs shall be limited to Los Angeles Avenue, Park Lane and Liberty Bell Avenue and shall be externally lighted. a. A maximum total of two 6 foot by 8 foot monument signs shall be permitted for the two major anchor tenants along Los Angeles Avenue. A maximum of four, 4 foot by 6 foot monument signs will be permitted for single use tenants (three along Los Angeles Avenue, one on Liberty Bell Road) . Lighting for the signs may be external or internal and individual letters (preferably channel letters) must be used. All lettering for all signs shall be of the same style. With Minor Modification No. 2 of CPD 89-2 , Shell Oil Company has requested approval of one 6' by 8' monument sign at the corner of Los Angeles Avenue and Park Lane to be used as a combined monument and pricing sign. This is one foot longer than the allowed monument signs for the two major tenants allowed to be placed along Los Angeles Avenue. Staff will support modifying the condition to allow a 6' by 8' monument sign at the corner since this will eliminate the need for an additional pricing sign along Park Lane and the proposed sign will have a duel purpose in that it will advertize the service station as well as the price of the fuel. PP09:29:92/10:01aM:\MINMODJ.CC 3 It appears from the first paragraph of Condition No. 19, there may have been an intent to have a monument sign along Park Lane in addition to the one allowed along Liberty Bell Road when the project was approved. However, allowing five (5) monument signs for the center would be more detracting from the center than allowing one larger pylon sign of sufficient size to advertize the name of multiple tenants, which would also benefit the smaller tenants. Therefore, staff intends to modify the condition to allow one monument sign for the Shell Gas Station and one pylon sign, not to have a height greater than 20 feet high. The major tenants will be allowed sign lettering no larger than 24 inches high and the other tenants will be allowed sign lettering no higher than 18 inches high. Therefore, staff intends to approve the following modification to Condition No. 19: 19. Prior to the issuance of a Zoning Clearance, a comprehensive sign program for the shopping center shall be submitted to the Department of Community Development. The sign program shall be designed to provide a uniform sign arrangement and design. Only individual channel letters shall be allowed. No lighted window signs will be allowed. The sign program shall be approved by the Director of Community Development or his designee prior to the issuance of a Zoning Clearance. PP09:29:92/10:01aM:\CINNOD3.CC 4 $levation Chance The City Council approved elevations for Shop Building No. 4 which included two center towers at the front and rear elevations. The applicant has informed staff that by eliminating the two center towers and replacing then with other architectural features as shown in the attached revised elevations, the architectural theme of the building will remain consistent with the proposed K-Mart building. Staff is of the opinion that with the existing tower provides a focal point for the center and that removing the tower would significantly detract from existing visual character of the proposed building. Therefore, staff intends to deny the requested elevation change to eliminate the center tower feature. The Director of Community Development has reviewed the proposed Minor Modification and plans to Conditionally approve it, as amended, with the exception of the proposed modification to the elevations. Pursuant to Resolution No. 88-523 , the Director has the authority to approve Minor Modifications. This matter is being presented to the City Council as a courtesy. In the event the City Council wishes to appeal the Director's decision, it may do so. Should the City Council desire to appeal, it should set a public hearing date. The next available meeting date would be the regular meeting of November 18 , 1992 . If the City Council takes no action, the Director's decision stands.
