SUBJECT: Consider Public Hearing Date for Fire Protection
District Facilities Fees
Summary
Section 66016 of the Government Code requires a Public Hearing for
the establishment of Fire Protection Fees. Council is being
requested to schedule a Public Hearing on November 18, 1992, to
consider an amendment to the City's Municipal Code 3.36 Article I
(Ordinance Number 8), Fire Protection District Facilities Fees.
Background
On October 5, 1983, the City of Moorpark adopted Ordinance Number
8 establishing fees for Fire Protection District Facilities. These
fees are imposed on residential, commercial and industrial
development for new construction, or expansion of existing fire
protection facilities to meet the increase in demand for service.
The County's 1992 Capital Improvement Plan shows the need for
additional fire protection facilities. The County and the cities
of Moorpark, Thousand Oaks, Simi Valley, and Camarillo have been
working together for over a year to come to an agreement on the
adjustment of Fire Protection Facilities Fees. At this time, only
the City of Moorpark and the County of Ventura have adopted
ordinances establishing Fire Facilities Fees.
A description and map of the of the Fire Protection Service Area
Boundary is attached as Exhibit A and a list of the existing fire
stations within the fee area is attached as Exhibit B.

The proposed amended formula for computing the fees is designed to
ensure that each new development bears only its estimated pro -rata
share of the costs. The amended ordinance also reflects the change
in the size of a "standard fire station" from 3,900 square feet to
5,700 square feet to accommodate current requirements for the
handicapped, female firefighters, and larger apparatus. This
amendment will bring the actual size of current fire stations into
the formula for determining the costs that will be charged to new
development.
The amendment also changes the definition of an "overextended" fire
station by providing that projected population will be computed as
-- of eight years, instead of five years, in the future. This longer
period more accurately reflects the amount of lead time needed to
fund and construct future fire stations. Finally, the proposed
ordinance amendment will allow future fee adjustments to be
approved by resolution of the City Council in the future.
On September 22, the County Board of Supervisors adopted the
!— amended ordinance and resolution approving the same fees to be
considered by the City Council. The City of Camarillo has
scheduled consideration of fees in November, and Thousand Oaks and
Simi Valley plan to consider the amendment in December.
Copies of the existing and proposed ordinances and resolutions have
been provided to Councilmembers under separate cover.
Recommendation
Staff recommends that Council set a Public Hearing on November 18,
1992, to receive comments on the amendment to the City's Code 3.36
Article I (Ordinance Number 8) and Resolution 83 -47 establishing
Fire Protection District Facilities Fees.
Fire Protection Service Area
Boundary Description
From a point of beginning where Wood Road and Pacific Coast Highway 1 intersect -
south along Pacific Coast Highway to Mugu Rock. At Mugu Rock extend south to the
coastline. Following the coastline southeast to the Ventura County -Los Angeles
County line. Then following the county line in a northeasterly direction to the
southeasterly corner of the City of Thousand Oaks where the county boundary line
turns east. Then easterly along said county line approximately seven miles to a
point where the boundary line changes to due north. Then north along said
boundary line approximately 5 miles to a point where the boundary line changes to
due east. Then along said easterly line approximately 2 miles. to a point where
the boundary line changes to due north. Then north along said boundary line
approximately 1� miles to a point where the boundary line changes to a
northwesterly direction. Then following the Ventura County -Los Angeles County
boundary along this northwesterly line approximately eight miles to where the
rancho line between Rancho Simi and Rancho San Francisco intersects. Then
following the rancho line due west to a point where Rancho Simi rancho line
assumes a southwesterly direction. Then following in that southwesterly
direction to a point approximately 2000 feet south west of Shekell Road where the
line meets the northerly rancho line of Rancho Las Posas. Then southwesterly
along that northerly rancho,,line to where it turns in a southwesterly direction
and crosses La Loma Road. Then following La Loma Road southwesterly until it
joins La Vista Avenue, then south on La Vista Avenue to Los Angeles Avenue. Then
due south along the westerly lot lines of.lots 36 and 37 to Beardsley Wash Which
separates the city limits of Oxnard and Camarillo. Then south on Beardsley Wash
to Beardsley Road. Then following Beardsley Road in a southwesterly direction
until it intersects Central Avenue. Then following Central Avenue in a south
easterly direction to the northeast corner of lot 47. Then following the
easterly line of lot 47 south to Highway 101. Then east on Highway 101
approximately 1,000 feet to the northeast corner of lot 53. Then following the
easterly line of lot 53 due south until it intersects Sturgis Road. Then east on
Sturgis Road to Pleasant Valley Road. Then northeast on Pleasant Valley Road to
Wood Road. Then south on Wood Road to Pacific Coast Highway 1 to the point of
beginning.
