Re: Amicus Brief For Greenwood v. City of
San Marino
Dear City Attorney:
We have been asked by the Legal Advocacy Committee of
the League of California Cities to prepare the Amicus Brief in
the above referenced action.
This case has serious "repercussions for cities in an
era of reduced revenues. If the Trial Court ruling is allowed to
stand annexation proceedings initiated by residents may be
required to go forward even where a city has determined that it
cannot deliver services to the annexed area without a net loss of
revenues. The requirement of property tax transfer agreements,
of Revenue and Taxation Code section 99 would be rendered void.
We urge you to join the City of San Marino as an amicus
in support of a city's right to prevent the forced annexation of
an unincorporated area which costs more to service than it will
generate in tax revenue.
