Modifications to the section 8106 of the Ordinance relating to Development standards and accessory structures in certain setback areas; 5. Add a provision in Section 8106 -8.6 to require that lighting shall be designed to have a sharp cut -off at property lines; 6. Changes to Article 8 related to precluding the conversion of three car garages in RPD zones, reducing parking requirements for affordable or elderly housing units, and several minor verbiage changes to make the Ordinance less ambiguous; 7. Changes to setback requirements for RPD Zones in Article 9 such as two story dwellings with windows facing adjacent properties, reduction in setbacks for affordable or elderly units obtaining a density bonus, requirement for varying the front setback of dwellings, and other minor language changes; 8. Addition to Article 10 requiring that the location of political signs be shown on a map and submitted as part of the application and that it is illegal to place them on top of, or on other signs; 9. Changes to Article 11 relating to entitlements requiring that signs for approved for Planned Development permits are governed by the permit and not Article 10 relating to signs, addition of a section relating to Temporary Use Permits and the addition of a provision relating to posting of property for public hearings; 10. Addition to Article 8 noting that in the event there is a question as to the location of a zoning boundary, the City Council has the authority to make a determination as to the location of the zoning boundary line and; 11. Add a provision to Section 8105 -5 allowing churches in industrial zones by approval of modifications to existing Industrial Planned Development Permits for buildings with approved IPD's, or with approval of an IPD for proposed new buildings; and In addition to the above, the following items were added by the Planning Commission at the public hearing on November 2, 1992: 1. Section 8106 -5.10 and 8106 -5.14 - change the word "match" to "complement ". 2. Section 8106 -8.6 - add the following section: i. The architectural design of the poles and lamp shall complement the design of the building. 3. Section 8108 -1 - The wording to m ( 2 ) and y. (1) shall be modified to read as follows: M. Section 8110 -3 (1) - shall read as follows: (1) Signs or banners announcing the opening of a new business which, in the aggregate, do not exceed ten square feet or 25 percent of the window area, whichever is greater. Section 8111 -2.2.2 - Variances ad section (e) which will read as follows: e. Administrative Variance by Director of Community Development Approval - A request for a minor variance from certain types of zoning regulations may be approved by the Director of Community Development as an administrative variance, if the standards of Section 8111- 2.2.2b. are met. An administrative variance may be granted through an administrative hearing process, only in the following situations: (1) To allow a decrease not exceeding 20 percent in required minimum setbacks; (2) To allow a decrease not exceeding 10 percent in required parking aisle width or similar dimensional requirements; (3) To allow walls, fences or hedges to exceed the height limit regulations by a maximum of one foot in setback areas, except in a required sight triangle; (4) To allow an increase not exceeding 10 percent for maximum building coverage, or sign area or height; and (5) To allow one of the required parking spaces for a single - family dwelling to be provided in tandem. The following addition to Sec. 8107 -1.4 - Mobilehome or Recreational Vehicle as Temporary Dwelling During Construction: A bond or cash deposit shall be required in the amount to cover removal of the temporary mobile home prior to receiving City approval for the placement of the temporary dwelling. The amount of the deposit shall be determined by the Director of Community Development. 7. The following addition to Section 8108 -1 m. (1): At the discretion of the approving authority, these standards may be reduced as a function of the review process for a Residential Planned Development if the units are to be constructed for senior citizens or affordable housing. It is the responsibility of the applicant to provide the approving authority with justification for reduced garage requirements. Although the Planning Commission did not indicate the amount of garages that could be reduced as a result of an applicant providing affordable or elderly housing, staff suggests that the City Council consider allowing up to a 50 percent reduction in parking for a senior citizen project and 25% for an affordable housing project. B. Clarification to the language of Section 8109 -2.3.1 relating to setbacks of two story residences. Recommendation: 1. Open the public hearing, take public testimony and close the public hearing. 2. Determine that the modifications to the City's Zoning Ordinance is categorically exempt pursuant to State CEQA Guidelines pursuant to Section 15061 (b) (3) in that the proposed amendments to the Zoning Ordinance does not have the potential for causing a significant effect on the environment. 3 Review the proposed changes, and advise staff of any additional recommended changes to the Zoning Ordinance. 4.
