SUBJECT: FIREPLACE INSPECTIONS - REQUEST FOR BIDS
Background:
The Council will recall that at the Council meeting of November
4, 1992 staff was instructed to prepare a Request for Bids (RFB)
for the purpose of obtaining proposals for inspection of the
fireplaces on the Pardee homes development portion of Tract 2865
(313 lots).
The Community Development Committee met on November 23, 1992 to
review this matter. The attached draft proposal is a result of
their discussions.
If the Council approves the RFB document staff would mail it to a
list of contractors which were supplied to us by the State
Contractors Board as well as companies known by staff to be
qualified to preform this work. We will also publish the
availability of the document in trade publications, such as the
DODGE Report. We believe that due to the upcoming holiday season
we should not expect responses until January 15, 1993.
Recommendation:
Direct staff as deemed appropriate.

REQUEST FOR BIDS TO CONDUCT
FIREPLACE INSPECTIONS
FOR THE CITY OF MOORPARK

The City of Moorpark is inviting bids /proposals for qualified contractors or contracting
company's to conduct fireplace inspections for the City of Moorpark.
SCOPE OF WORK.
The City of Moorpark Department of Community Development, Building and Safety
Division is seeking a qualified firm to inspect the existing fireplace units in more than two
hundred fifty (250) homes to identify possible building code violations including
installations contrary to manufacturers specifications. The inspections and any code
violations will be documented on forms provided by the City.
The units to be inspected have been installed and access to all fireplace components
may not be possible. In the event that elements of a fireplace are inaccessible for an
inspected to be performed, the contractor /contracting company shall identify the
components of the fireplace which were unable to be inspected.
The selected contractor must exhibit a proficiency in Uniform Building Code interpretation
especially as it pertains to fireplace construction, installation, and inspection.
All inspection findings shall be submitted to the City in type written form or legible
printing. The City will spot check the inspection process at its own expense. The City will
be responsible for scheduling of fireplace inspections and property access. The fireplace
inspections will be scheduled so that the contractor /contracting company conducts as
many fireplace inspections as possible within an 8 hour period. Scheduling may also
include work on Saturdays and Sundays. The work is expected to be completed in 45
calendar days or less.
CONSULTANT REQUIREMENTS:
The contractor /contracting company selected must meet the following criteria:
1. A minimum of three (3) years of licensed experience in fireplace installation,

2. An appropriate and valid State Contractor's license.
3. Verification that no uncomplimentary statements have been made to the
appropriate Better Business Bureau, State Contractor's Board, or a Chamber of
Commerce by aggrieved customers or employers; or written documentation that
any such complaint has been remedied to the salification of the agency initiating
or receiving the complaint.
4. A minimum of three (3) job references. Reference from current and /or previous
employers or customers, including name, title, work address, and telephone
numbers of the persons whom the contractor /contracting company has worked
(works) closely with on each job reference.
The selected contractor /contracting company will provide his /her own office space,
telephone, clerical support, supplies, and his /her own vehicle for any required field work.
PROPOSAL REQUIREMENTS:
All interested contractors /contracting companies must submit five (5) sealed copies of
their bid for procurement of the City Fireplace Inspection Service to:

BIDS MUST BE RECEIVED BY 5:00 P.M. ON JANUARY 15, 1992
A bid being submitted shall include all of the following:
1. Resumes of person(s) who will perform the inspection and any other persons who
may conduct minor review as needed to complete a fireplace inspection.
2. A description of the proposed process the contractor /contracting company will use
in order to conduct fireplace inspections; said process should be consistent with
the scope of work outlined on the previous page.
3. The cost to the City for conducting inspections. Said cost shall be given assuming
the entire contract will involve 250 homes. Further, said information shall include
a per inspection cost for each home over the original estimate for 250 homes.

4. An acknowledgement that billing will be paid on the City's schedule. Bills must be
received by the City no less than 15 calendar days prior to the first (1 st) and third
(3rd) Wednesdays of each month. Further, that the City will pay 90% of all billing
invoices. The final 10% will be paid 30 days after project completion.
5. Insurance:
Contractor /contracting companys shall secure from a good and responsible
company or companies doing insurance business in the State of California, pay
for, and maintain in full force and effect for the duration of the contract the policies
of insurance required by this Section and shall furnish to the City Clerk of the City
certificates of said insurance on or before the commencement of the terms of the
contract. Notwithstanding any inconsistent statements in any of said policies or any
subsequent endorsement attached thereto, the protection offered by the policy
shall:
(a) Further, the policy shall bear an endorsement or shall have attached a rider
whereby it is provided that, in the event of cancellation or amendment of the
._ . policy for any reason whatsoever, the City Clerk shall be notified by
registered mail, postage prepaid, return receipt required, not less than (30)
days before the expiration, cancellation or amendment is effective.
(b) Consistent with the aforementioned policy, the contractor /contracting
company shall provide general public liability including automobile liability
and property damage insurance in an amount not less than Two Million
dollars (2,000,000.00) per occurrence and annual aggregate.
(c) Consistent with the aforementioned policies, the contractor /contracting
company shall provide professional liability insurance in an amount not less
than One Million Dollars ($1,000,000.00) per occurrence and annual
aggregate. In the event the amount of professional liability insurance
provided to another public agency client of the contractor /contracting
company is more than One Million Dollars ($1,000,000.00), this same
coverage shall be extended to the City so long as it can be provided at no
additional cost to the contractor /contracting company. The
contractor /contracting company shall give the City thirty (30) days written
notice of intent to provide professional liability insurance in excess of One
Million Dollars ($1,000,000.00) to another public agency client and offer the
same coverage to the City at the City's expense.

(d) Consistent with the provisions of this Section, the contractor /contracting
company shall provide workers' compensation insurance as required by the
California Labor Code. If any class of employees engaged by the
contractor /contracting company in work under this Agreement is not
protected by workers' compensation law, the contractor /contracting
company shall provide adequate insurance for the protection of such
employees to the satisfaction of the City.
6. Indemnification:
The contractor /contracting company hereby agrees to indemnify, defend and hold
harmless the City, and its officers, employees, servants, and agents from and
against any and all claims, liability, loss, damage, cost, and expense, including
court costs and attorneys fees, whether or not litigation be commenced, of
whatever nature or type, that the City or any of its officers, employees, or agents,
many hereinafter suffer, incur, be put to pay or lay out by reason of:
(a) Any injury or death to any person or damage to any property sustained or
alleged to have been sustained as a result of the work, or the performance
hereof, contemplated hereby, or any defect in material, equipment, or
workmanship that becomes evident within one year after the date of project
completion.
(b) Any other act or omission of the contractor /contracting company, its agents,
representatives or other persons who are at any time engaged in the
course of work or in the repair, replacement or restoration of any portion
of the work made necessary by any defect in material or workmanship
including, but not limited to, subcontractors, laborers, materialism, and
suppliers; or
(c) Any breach or default of the contractor /contracting company in the
performance of its obligations herein described.
7. The contractor /contracting company shall file with the City a disclaimer
indemnifying the City for possible damages caused by the contractor /contracting
company due to inspection of the fireplaces.
Discretion shall be given to the City as to acceptance of a bid submittal which has not
submitted all of the required information, as outlined in the aforementioned Section titled,
"Proposal Requirements." Unauthorized conditions, limitations, incompleteness, or
provisions attached to a proposal will render it irregular and may cause its rejection.

DELIVERY OF BIDS:
Bids shall be enclosed in a sealed envelope plainly marked on the outside, "FIREPLACE
INSPECTION BID - DO NOT OPEN WITH REGULAR MAIL. Proposals may be mailed or
delivered by messenger. However, it is the bidder's responsibility to ensure delivery of
the bid to the hands of the City's designated official. Late bids will not be considered.
SELECTION PROCESS:
The City will select a contractor /contracting company pursuant to the following process:
1. All bids and proposers' qualifications will be carefully reviewed.
2. Interviews may be conducted with those contractors /contraction companies judged
to have the best qualifications and experience for the City.
3. The City Council will award a contract to the contractor /contracting company.
AWARD OF CONTRACT
The award of the contract, if made, will be to the lowest overall responsible bidder as
determined solely by the City. Additionally, the City reserves the right to reject any or all
bids, to waive and irregularity, and to take the bids under advisement for a period of sixty
(60) days, all as may be required to provide for the best interests of the City. In no event
will an award of a contract be made until all necessary investigations are made as to the
responsibility and qualifications of the bidder to whom the award is contemplated. All bids
will be compared with the Engineer's Estimate.
SELECTION DATE:
The City intends to award the contract in February of 1993.
