SUBJECT: Status of the Filming Permit Process in Moorpark
Staff was asked to report on the status of the City's film
permitting process.
The City averages approximately ten filming projects per year. In
the past seven months, there have been seven filming projects in
the City that staff is aware of. At least three projects have
occurred without City approval, and five other projects occurred on
private property. The number of requests to film in the City have
increased from three to four requests per year in 1989 -90, to
approximately 15 requests per year in 1994. It is important to
note that we also receive several inquires each month which do not
result in a film project.
The filming application provided in Attachment "A" is the City's
tool for initiating a film permit request. The submittal fee is
ten dollars, and from the information on the application, staff
develops project conditions which are attached to a temporary use
permit (zone clearance, $39). If the use of public property is
requested, an encroachment permit is issued for $35.
Typically, staff receives a phone inquiry asking about our film
permit procedures. Then a location scout or an assistant comes in
to City Hall to pick up and in many cases to fill out the
application form and to submit the application fee of ten dollars.
The applicant is required to provide information regarding the
scope of the film activity and the time frames for filming. The
scope includes the equipment being used, use of pyrotechnics,
required street closures, noise control and other aspects of the
filming project.
Staff reviews the application, estimates the staff time necessary
to process, and to oversee the film project and then provides an
estimate to the applicant. The applicant is then required to pay
a deposit to cover the City's anticipated expenses, plus a fifty
percent contingency amount. When the deposit is received the City
begins the processing of the application by circulating it to the
appropriate departments and agencies for review and the development
of additional conditions. Currently, staff will talk with each
property owner or business owner prior to approving the permit and
incorporate special concerns into the permit conditions when the
project is proposed for a sensitive part of the City. When all
conditions are received and compiled by staff the applicant is
informed and if the applicant agrees to comply with the conditions
the permit is issued.
This process takes between one and four weeks to complete. The
more complex the filming, naturally the longer the processing.
Additionally, projects on public property or in commercial areas
such as High Street require longer periods to process because they
impact a greater number of residents or businesses. During the
processing of a permit, staff members must set aside other
assignments to respond to the urgency of the processing of the
permit.
When a project occurs entirely on private property, the cost to the
City for monitoring is usually less than $100 per day. When a
project occurs on public property and in sensitive areas, the cost
may be as high as $2,000 per day or more.
Most permit requests related to television commercials and network
television episode filming have been denied, because they typically
need permit approval in less than five working days. Movies and
documentaries have more lead time, allowing staff to work closely
with the applicant and with the impacted area.
In the past the City's goal was to preserve staff time for projects
which directly served Moorpark residents and businesses. Filming
was not viewed as a direct benefit or service to the community.
Recent State legislation requires communities to be supportive of
the film industry. Since that time the.City has been supportive
and worked to process inquires and permits expeditiously, however,
it has been at a cost in addition to the financial impacts of
direct salary. Priorities established by the City Council must be
put off when a film permit is being processed.
It has been suggested that the City take a more proactive approach
and encourage filming in Moorpark. Specifically, the High Street
area and some of our surrounding open spaces have been viewed as
prime locations for filming. There has been resistance to filming
on High Street by some of the business owners. This resistance
results in more staff time, as noted previously. There are also
concerns related to the issue of staffing a proactive effort and
its impacts on other activities more directly related to serving
the residents and businesses.
The State Film Commission is not in favor of the passage of an
ordinance. Standard conditions are not generally viewed favorably,
because they could be constraining. If it is the City's goal to
encourage and facilitate filming, it would be more appropriate to
assign permitting responsibility to one office or contractor and
allow that office /contractor to independently approve filming with
minimal regulation.
Staff has previously drafted an ordinance and had it reviewed by
the State Film Commission. They indicated that it would comply
with the current state requirements, but they opposed its adoption.
It was not brought forward to the City Council. If Council
requests that the an ordinance be prepared as a priority item in
fiscal year 1994/1995, it would require about 20 hours of staff
time to update the draft and then the City Attorney's review of
the ordinance to bring it forward for consideration.
Potential Revenue
The State views filming as a major industry and encourages support
of that industry at the local level. Indeed, some Moorpark
residents are employed directly in the film industry or by firms
which receive some of their business from the film industry.
However, the direct benefits of filming in the City are not
clearly evident. Because of the City's proximity to the film
studios, the studios rely on their own caterers, there are no
overnight stays required, and individual commuting with increased
traffic result from filming. Local businesses have complained that
filming cuts down on their number of customers, because of street
closures and interference with pedestrian access.
Further, the State prohibits the City from making any revenue in
excess of actual costs for filming on private property within the
City. If the filming is on public property the City can receive a
fee for use of the public property or rights -of -way.
Managing a Proactive Filming Policy
If the City's policy is amended to encourage filming on public
property and right -of -way, to increase revenue and to increase the
exposure of the City, then a method would be needed which would
ensure that other priorities of the City Council are not sacrificed
to meet the urgent needs of the filming companies. The use of flat
fees for filming on public property, the use of an independent
contractor to process the permit, monitor compliance and to scout
and promote locations should be considered.
Recommendation
Direct staff as deemed appropriate.

This informational packet has been prepared to assist you in meeting the
requirements for filming in the City of Moorpark. All Filming Permits
are required to be submitted to the City 30 days in advance of filming.
Please complete the attached Filming Permit and submit to the City Manager's
office. The City Manager's office can assist you by providing information
as to the proper procedures that must be followed when filming in Moorpark.
Your permit will enable the office to determine the necessary number of
safety personnel that must be present during filming. Depending on the,
accommodations that must be made for the filming, the City Manager
may approve your plans. If he determines that the disruption to the
citizenry of Moorpark is substantial, he will submit the matter to the
City Council for its approval. The Council may or may not impose additional
requirements for you to meet prior to filming, depending upon the circum-
stances of your request.
If the City Manager has approved your filming request, then a Certificate
of Insurance (as described on the "Permit" ) and an estimated deposit fee
must be received by the Finance Department 12 hours in advance of the filming.
Any cancellations of the "Film Permit" after the i2 hours prior to filming
will still be charged the minimums for the personnel charges.
The City provides personnel only for :safety purposes and crowd and traffic
control. Final authority on all safety matters will be held by the Fire
and Police Officers assigned to the filming company. No additional
equipment will be supplied by the City. Upon the direction of the Police
Department, you will be informed as to the necessary barricades, etc.,
that you must provide. Also, City policy prohibits the use of such City
equipment as fire engines, police cars, etc., for filming purposes.
Approvals of all businesses or homeowners within a 300 foot radius of the
filming location must be received by ih,- City five (5) days prior to
filming date.

PERMIT FOR MOVIE AND 'M,`
1. Awareness and compliance with all per-nit conditions.
2. The permittee is required to :Hake arrangements with the
California Highway Patrol for patrolmen to be present during
filming, for traffic control purposes.
3. Walkie- talkies to be continually maintained in working condi-
tion, shall be provided by the permittee for the City of
Moorpoark Inspector and for each Highway Patrolman for use in
traffic control.
4. The permittee shall be responsible for providing, installing
and maintaining traffic signs in accordance with the traffic
control plan (over).
5. Limit traffic delays to three minutes maximum under the direc-
tion of California Highway Patrolmen only.
6. Two way traffic shall be restored at the end of each three min-
ute maximum delay.
7. Minimize the number of vehicles and personnel on City right
of way.
8. Park all vehicles off the traveled way as far as possible on
the right road shoulder.
9. Keep pedestrians out of the traveled way.
10. Display courtesy to passing motorists.
11. Sweep traveled way clear of dirt and other debris resulting
from the filming.
12. Refrain from using or disturbing private property without prior
consent of the property owner.
13. Base camp to be located on private property not in roadway or
on road shoulder.
14. Refrain from removing road signs, street name signs or dis-
turbing in any way City property or road facilities.
15. Covering of signs permitted during periods of traffic delays
only.
16. Use of vehicles in the performance or stunts, chases, swerving,
near misses and crashes, is subject to all limitations that
may be imposed by the California Highway Patrolmen and /or City
of Moorpark Inspector on dur_y at the filming, which, in their

17. All vehicles, including but not limited to those used to trans-
port personnel and cameras, sound and lighting equipment and
reflectors, shall be restricted to loading and such other limi-
tations as may be deemed appropriate by the California Highway
Patrolmen and /or City of Moorpark Inspector on duty at the
filming.
18. Failure to comply with all permit conditions or to conduct all
operations as directed by the City of Moorpark Inspector shall
result in a cancellation of this permit.

PROCEDURES: Dodie reviews completed application; if proposed filming is on a public
R -O-W, she contacts Traffic Department and coordinates their
involvement. City has a "Special Event Permit ". Business license is
$50.00 /day; no fee for filming on private property; no other fee. Police
Department may send officers to some filming sites. Approximately 2 or
3 films a month; Camarillo House by far is favorite film site location.

CITY ORDINANCE: City of Fillmore has Ordinances pertaining to Filming Permits and
Filming Fees.
Fillmore averages about two (2) to three (3) films a month.
Film company is required to complete an "Application for Film Permit" and
"Attachment "A" ( "Location Summary").
Completed application is returned to Noreen Withers who usually requires a lead
time of at least 3 days prior to filming.
Noreen circulates the application to the City Police, Fire and Public Works
departments for review, approval and any conditions; and for estimated number
of staff and number of hours required.
Noreen says that a fireman is almost always required at film site; police only get
involved if traffic control or pedestrian safety is needed.
Fillmore required that all fees be paid prior to actual filming (especially for
Safety personnel).

PROCEDURES: $10.00 Filing Fee; City is reimbursed for actual costs; completed
application is sent to other city agencies (Engineer, Sheriff, Fire, etc.) to
determine involvement and estimated cost of services; estimated cost plus
an additional 50% deposit is required from film company; any funds left
over from deposit is returned to applicant.
Most stringent rule is 30-day advance notice mainly for filming along
quaint High Street (location of theater and shops). This area is bordered
by 2 busy State Highways requiring that application be reviewed carefully.
If more than 1 or 2 day of filming is proposed, application is sent to City
Council for its review and approval.
Don Reynolds would like for Frank Ugolini to notify him about any
filming on County unincorporated area that may somehow impact
residents of Moorpark. A fairly recent example is filming done at a
abandoned airstrip that bothered Moorpark residents nearby (apparently
airplane noise).
Moorpark has an estimated one or two filmings a month.

NUMBER AND TYPES OF FILMS: Probably less than six (6) films a year. Brady has noticed
a drop in film applications for the past three (3) years or so. He doesn't know the reason for
this.
The most popular location for filming is the Port Hueneme Beach Park and Fishing Pier.
Because of heavy truck traffic, filming is not permitted on Hueneme Road. No filming
involving collisions, hazardous stunts, or vehicle speeding is permitted in the City.

City has a comprehensive "Policies and Procedures for the Issuance of Filming and Still
Photography Permits" that is given to applicants.
City requires the completion of a "PHOTOGRAPHY /FILMING PERMIT" application
to be submitted at least rive (5) working days prior to filming. Some permits may
require more or fewer working days notice.
Application is reviewed by other City agencies; for example, by the Public Works
Department (roads) and by the Police Department for filming on public roads.
Brady also requests review and approval by the California Coastal Commission if the
filming may restrict public access or parking to the beach and pier. He also notifies
Ventura County's Environmental Health Division if a food caterer will be used.
A Film Permit is required for filming on public as well as private property.
The city has a Film Ordinance adopted in the late 1980's.
Applications for filming in the U.S. Naval Construction Battalion Center must be made
directly to the U.S. Navy.
If city policemen are used to assist in filming, the film company pays those individuals
directly ($37.50 per hour).

Film company is limited to maximum of 5 production vehicles parked on public streets which
shall not exceed a maximum of 200 feet of parking within the immediate proximity of filming
location.
Bob Gonzales has authority to rent any of 4 large City-owned parking lots. City charges a
minimum of $445.00 /day for use of each City facility. Fee is negotiable.
Any filming in the CBD requires the following (see details in "REQLMLENMWS FOR
FILMING IN CBD "):
1. A pre - production meeting with affected businesses.
2. Posting of Signs.
3. Public Notice/Announcement (min. of 2 days prior to filming).
4. Special Promotion Activity (to promote access to merchants).
5. Business Contracts (with each affected CBD merchant).
6. Industry Code of Conduct.
Bob Gonzales provides completed Film Permit Application to Police, Fire and Maintenance
officials to determine their estimated involvement (no. of people and no. of hours).
Bob Gonzales works closely with Santa Paula Chamber of Commerce liaison; the latter informs
film company how much it should pay each merchant or resident impacted by filming activity.
Bob Gonzales and Chamber of Commerce liaison (Carolyn Bowker) promote filming because
it brings money into community. Santa Paula also has stringent regulations and monitors filming
activities closely.
Bob Gonzales always visits each proposed filming location with the location manager and
producer so that he can find out what conditions must be specified in permit.

FILM PERMIT PROCEDURES
CITY OF SIMI VALLEY

NUMBER AND TYPES OF FILMS: Approximately one (1) or two (2) Film Permits issued
per month. Most recent feature film in Simi Valley was "Poetic Justice". No particular sites
stand out as most popular. Sites used include a 1950 -style Drive -In, Paramount Ranch,
Hummingbird Ranch, and Marr Ranch.
APPLICATION AND PERMIT PROCEDURES:. Film company must complete a "Location
Filming Application" which is forwarded by the Dept. of General Services to Planning, Fire
Dept., Compliance'Div., Public Works, Police Dept., Building & Safety, and City Attorney for
review, approval and any needed Conditions. These recommendations are reviewed by the City
Manager's Office.
If requested by the applicant, and approved by the City Manager's Office, a Filming, Application
Review Committee, composed of representatives of City agencies, shall meet in cases of filming
involving considerable public impact. City Manager's Office shall conduct the meeting. This
Committee has met only a few times.
FILING DEADLINES: Completed permit applications for filming involving nQ public roads
or aircraft or special effects or is entirely on private property must be filed at least five (5)
working_days prior to the scheduled filming date. Applications for all other location filming
must be filed fifteen (15) working days prior to the filming.
Bob Heitzman said the City is in the process of revising the filing deadlines by adding a "3 -day"
deadline for minor filming such as a one -day commercial. The film permit fee for minor filming
will probably be less.
NOTIFICATION TO PUBLIC: Any filming involving traffic control or activities not normal
at the film location will require a "Notification to Public ". The City Manager's Office will
make final determination of notice requirements and notification method (mail or hand
delivered).

NUMBER AND TYPES OF FILMS: City probably averages about four (4) films a month.
Roy Meyers says that most filming seems to occur during summer months; filming after
September tends to be mostly commercials.
APPLICATION AND PERMIT PROCEDURES: There are nQ requirements for filming on
p� property except that film companies must contact and receive permission from any
neighbors impacted by filming.
Filming proposed on public road right -of -ways or public property requires the completion of a
"COMMERCIAL FII.MING ENCROACHMENT PERMIT AND TRUST FUND DEPOSIT
FORM ". Police Dept. reviews applications and determines if and how many police officers will
be needed; what the estimated Police Dept. charges will be; and any Special Conditions of
Approval. Public Works then determines the Encroachment Filming Fees and any Special
Conditions of Approval it may have. Fire Dept. only gets involved if pyrotechnics are used.
PROPOSED NEW ORDINANCE: City has a final draft of a proposed Ordinance and
accompanying Resolution concerning filming activities. The proposed Ordinance, drafted in
October, 1991, is quite comprehensive and based largely on the Ordinance used by the city of
Simi Valley. In the proposed Ordinance, applications for a film permit on public property will
still be handled by the Police Dept. Public Works will then handle the "Public Works" section
of the application. Applications for filming on private property will be handled by the Dept. of
Public Works. Business licenses will not be required on either public or private property in the
proposed Ordinance.
FILING DEADLINES: Proposed Ordinance stipulates the following filing deadlines:
(a) Filming on private 12=M: Applications must be filed with Dept. of Public
Works within = days prior to scheduled filming.
(b) Filming on Public prg=M: Applications must be filed with Police Dept. at least
seven days prior to scheduled filming.

Doesn't get many requests for filming (at most, one or two per month); Carole feels that the
large number of palm trees in Ventura restricts filming that needs other backdrops. She thinks
City gets more requests for student films than commercial films.
Film company completes a "APPLICATION FOR SPECIAL EVENT" and "FILM PERMIT -
AGREEMENT" forms and submits them to Carole. She distributes application to City agencies
(primarily Police, 'Fire and Park) to see if they need staff at the site and for how many hours.
If approved, Carole types out a "FILM PRODUCTION SPECIAL EVENT AGREEMENT"
which is essentially a letter specifying all the fees needed, insurance required, and conditions
that will be imposed by City.

The following requirements must be met for and all filming of

If the following requirements are not met the Merchant's Film
Committee has the option to cease immediately all filming and the
fees and monies forfeited to the Merchant's Film Committee and the

2. PRE - PRODUCTION MEETING WITH FFECTED BU ESSES: The applicant
shall contact The Merchant's Film Committee or Liason to arrange
for a pre- shooting location /production meeting where all details
(parking, fighting, business interruption, etc.) regarding the
shoot can be discussed prior to formal issuance of a City
Filming Permit. The Committee must approve the filming project,
and may have additional requirements based on the particular
circumstances regarding the nature of the filming activity itself.
3. POSTING OF SIGNS: The permitee shall post one (1) sign of
suitable size at each end of the filming area. The purpose of
this sign is to advise passers -by of the name of the film, its star
or stars, and its approximate date of showing. In addition to the
above mentioned signs, the permitee shall post a minimum of one
(1) sign of suitable size at each end of each business area in
the filming area. The purpose of this sign is to advertise the
name of the affected businesses and the fact they are open
for business during the filming activiity. Appropriate signs
must be placed at the end of each filming area directing
people to the nearest available parking areas.
4. ADVERTISING: The permitee shall cause to be printed two (2)
announcements /advertisements of suitable size (a minimum of
a 1/4 page) about the filming activity and listing the names
of the affected businesses which will be open for regular
business while the filming activity occurs. The announcements/
advertisements shall run in the Ventura County Star Free Press,
The Fillmore Herald and The Fillmore Gazette with the first
ad occurring a minimum of two (2) days prior to the commencement
of filming and the second ad occurring the first day of filming.
5. PARKING OF ANCILLARY VEHICLES: The permitee is limited to
a maximum of four (4) production vehicles within the immediate
proximity of the location. All other ancillary vehicles must
be parked in a designated location subject to approval by
The Fillmore Merchant's Committee via Liason person.
6. HOLIDAY SEASON BAN: No filming shall be allowed in the Central
Business District from Thanksgiving until January 1st.

Requirements For Filming In The Central
Business District of Fillmore
?. FEES PAID TO BUSINESS OWNERS: The basic fee for filming in
the business districts of Fillmore will be $15.00 per running
foot in traffic restricted areas during the hours of 5:00 a.m.
to 9:00 p.m. and $5.00 per running foot during the hours of
9:00 p.m. through 5:00 a.m. Traffic restriction is both vehicle
and foot traffic.
Individual businesses being filmed and the business directly
adjacent, (i.e. left and right), will be compensated according
to the negoiations by owners of these businesses and the film
industry, and signed contracts will be required at the conclusion
of these negoiations.
A liason person picked and approved by the Business District
will be paid $5.00 per business involved, per 8 hour day or
$100/8 hours - 8 hour minimum whichever is the greater, by the
filming industry.
Payment by the film industry shall be made in advance unless
otherwise agreed upon by the Merchant's Film Committee.
8. BOND: There will be a $20,000 bond provided by the film company
for damages, or non - payment to business owners.
9. CREDITS: All filming in the Central Business District will be
noted in the film, that the film was filmed in the City of
Fillmore.
10. INDUSTRY CODE OF CONDUCT: The permitee shall see to it that
all of its employees shall comply with all provisions of the
Industry Code of Conduct as provided by the California Film
