Consider Revisions to Contract for Engineering
Services
This requests approval of certain changes to the Agreement
for Engineering Services.
DISCUSSION
A. Background: In March of 1991 the City entered into an
Agreement for City Engineering Services with Charles
Abbott Associates.
B. Retainer: Section I, Paragraph A of the Agreement
provides for an automatic adjustment to the retainer each
November 1. This increase (also 3.1 %) is more fully
defined in a Memorandum to the Finance Department dated
November 10, 1992, a copy of which was provided to the
City Council.
C. Hourly Rates: Section I, Paragraph I of the Agreement
provides for the annual adjustment of the hourly rates for
said services as set forth in Exhibit "B" of the
Agreement. Subject to the approval of the City Council,
said adjustment shall become effective on November 1 of
each year. Said adjustment shall be equal to the increase
in the Consumer Price Index (CPI) for the U. S. City
Average for All Urban Consumers All Items, for the twelve
month period ending the prior August, provided said
increase does not exceed seven per cent (7%).
The amount of the increase in the specified CPI is 3.1 %.
Attached is a revised Exhibit 'B' to the Agreement setting
forth the current rates along with revised rates based on
an the 3.1% increase.

D. New Position: The position of Associate Civil Engineer
has been added to the list of Personnel Services listed in
Exhibit 'B' of the Agreement (attached), at the hourly
rate of $65. The job description and the minimum
background, experience and qualifications for this
position will be developed by the Director of Public Works
with input from the Assistant City Engineer.
E. Lot Line Adjustments: Section I, Paragraph D of the
Agreement provides for the review of matters relating to
Land Development, including such matters as tentative
maps, lot line adjustments, development plans, general
plan amendments, zone changes, etc. ,5()F4is paragraph
provides for payment of twenty -five of the fee
deposit for such an application to the City Engineer, with
the reuwrr going to off -set City Planning costs.

Experience nas shown that the majority of time and expense
related to the processing of a Lot Line Adjustment is
incurred by the City Engineer's Office. It is
recommended, therefore, that seventy -five per cent (75 %)
of the fees for this category of work go to the City
Engineer.
The following changes to the Agreement are recommended:
D. Land Development Review
1. Except as noted in Paragraph I -D -2 below,_ for
services as described in Exhibit "A", Section D,
review and conditioning of tentative maps,
development plans, general plan amendments, zone
changes and similar projects will be provided at
a fee of twenty -five percent (25 %) of the then
current initial fee deposit collected by the
City. In the event a project is withdrawn by
the applicant at any time during the review
process, the Engineer shall receive a fee based
on actual time expended not to exceed twenty -
five percent (25 %) of the initial fee deposit
collected by the City for that project. For
projects requiring a special or extra traffic
engineering analysis beyond the usual review,
the Engineer shall receive additional
compensation for actual cost for preparation or
review of such analysis. For such service, the
Engineer shall provide City with a quotation and
shall not proceed until written approval is

granted. Determination on whether a project
requires special or extra traffic engineering
analysis shall be made by the City after
consultation with the Engineer. The
environmental checklist for a project will be
used as a guide on this determination. The
services provided by the Engineer pursuant to
this Paragraph D. shall be performed in a timely
manner to allow City compliance with the
processing requirements of the Permit
Streamlining Act.
2. For services as described in Exhibit "A ",
Section D. the review and conditioning of Lot
Line Adjustments will be provided at a fee of
seventy -five percent (75 %) of the then current
initial fee deposit collected by the City. All
other provisions of Paragraph I -D -1 shall apply.
RECOMMENDATION
Staff recommends that the City Council approve the following
revisions to the Agreement for Engineering Services:
1. approve a 3.1% increase in the rates for Engineering
Services;
2. approve a new Exhibit 'B' (attached) which adds the
position of Associate Civil Engineer; and,
3. approve the above changes to Section I -D relating to
payment for services related to the processing of Lot Line
Adjustments.

Amendment to Agreement for City Engineering Services
At its regularly scheduled meeting of December 16, 1992, the
Moorpark City Council approved the following amendment to the
Agreement for City Engineering Services with Charles Abbott
Associates, March 1, 1991.
1. In order to provide for an adjustment in the hourly rates for
services rendered, and to add the position of Associate Civil
Engineer to the list of services provided, Exhibit 'B' of the
Agreement is amended to read as the revised Exhibit 'B'
attached hereto.
2. Section I D of the Agreement is hereby amended to read as
follows:
