(VACANCY CONTROL IN MOBILEHOME PARKS) AND COUNCIL RECONSIDERATION OF ORDINANCE 153. BACKGROUND: Ordinance 153, amending Chapter 5.52 of Title 5 of the Municipal Code relative to Mobilehome Park Rent Stabilization, was adopted on October 7, 1992. On November 6, 1992, prior to the effective date of the Ordinance, a Referendum Petition Against Ordinance 153 was accepted by the City Clerk for filing and handcarried by the City Clerk (accompanied by a Sheriff's Department Officer) to the County Clerk's Office for verification of signatures on November 9. The County Clerk's verification and certification as to the sufficiency of 1,507 signatures on the Referendum Petition was received December 9. Signatures of 1,351 registered voters of the City (10% of the registered voters) was necessary to determine the petition sufficient (Elections Code 4051). The City Clerk must certify a sufficient petition to the City Council at the next regular meeting of the Council after the sufficiency is determined (E.C. 3707). The Council may now either (a) repeal the ordinance, or (b) call an election. If the ordinance is not repealed, an election is required to be held at the "next regular municipal election occurring not less than 88 days after the order of the legislative body or at a special election called for the purpose not less than 88 days after the order of the legislative body" (E.C. 4055). Copies of the resolutions necessary to call a special election will be provided to the Council prior to Wednesday, December 16, to enable the Council to act immediately to call the election if such action is determined by the Council. Eighty -eight days from December 16 would be March 14, the date after which an election could be held. An election calendar will be requested from County Elections for the December 16 meeting. The cost of the March 5, 1991 Special Election was $20,573.11. The County Assistant Registrar of Voters has indicated that 5% should be added to the cost of the city's last special election to arrive at an estimate for a special election to be held in the March 1993 -- approximately $22,000. STAFF RECOMMENDATION: 1. Receive and file the City Clerk's report on the sufficiency of the referendum petition; 2. Repeal Ordinance 153 or order the submittal of the ordinance to the voters at a special election and direct the City Clerk to prepare the resolutions to call the election. Attachments: 1.
