Hayes, Economic Development Manager�'�� August 23, 1993 (City Council Meeting of 09- 08 -93) SUBJECT: Request to Provide Incentives for Mail Marketing Corporation BACKGROUND: Mail Marketing Corporation is proposing to construct a 414,500 square foot facility on a site containing 19.3 acres located northwest of the 23 Freeway and New Los Angeles Avenue. The applicant (G &S Properties) has been working with the Community Development Department on this project and has submitted preliminary plans for the City's review. The Planning Commission is scheduled to consider the proposal on September 10, 1993. DISCUSSION: The applicant's representatives have met with an ad hoc City Council Committee (Perez and Wozniak) concerning incentives to build the proposed project in Moorpark. The Council Committee made three (3) recommendations that affect the standard conditions of approval as follows: 1. Condition Number 45 - The applicant shall contribute to the City of Moorpark's Art in Public Places Fund, an amount of $10 per each 100 square feet of building area. Committee Recommendation - In lieu of the required payment the applicant shall expend an equivalent or greater amount of money to enhance the design or the entry treatment for the project. 2. Condition Number 85 - The applicant shall execute a covenant running with the land on behalf of itself and its successors, heirs, and assigns agreeing to participate in the formation of an assessment district or other financing technique including, but not limited to the payment of traffic mitigation fees, which the City may implement or adopt, and to fund public street and traffic improvements directly or indirectly affected by the development. The covenant is to be approved by the Director of Community Development and City Attorney. Committee Recommendation - The Committee and applicant recommend, subject to Council approval, to substitute this condition with the following prior to issuance of the zone clearance for the building permit. The applicant shall pay $200,000 to satisfy its obligation for City wide traffic mitigation. 3. Condition 50 - The applicant shall pay a fee established pursuant to Ordinance 102 in the amount of $ .05 per sq. ft. to be used to install, maintain and replace landscape work on public property for the purpose of mitigating the removal of the natural landscape from the property of the new development. Committee Recommendation - The Committee is recommending to the Council that this condition be deleted since the site has been graded for several years and all natural landscape was removed at that time. This was the same action the City Council took with the recently approved Kavlico project. A schedule of fees as determined by the Community Development Department for this project is attached as Exhibit "A". The Committee has requested Mail Marketing to describe what benefits their business will provide to the community and what support the community can expect from their firm. In particular, the committee has asked for a commitment regarding jobs for youth or other job programs including a guarantee for part time jobs for youths after school and /or in the summer. RECOMMENDATION• That the City Council direct Staff as deemed appropriate.
