Anderson, owner of the AC Construction site located at 2875 Spring Road is interested in using a portion of the existing storage facility for the purpose of having temporary storage of recreational vehicles. The existing zoning of the property is CPD (Commercial Planned Development). The Assessor's Parcel Number is 506- 0- 02 -64. The site is approximately 6.8 acres. Discussion Ordinance Reauirements Section 8105 -5 of the Zoning Ordinance allows the storage of recreational vehicles in the M -2 zone only with approval of a Planning Commission approved Planned Development Permit. As previously mentioned, this site is zoned CPD and under normal circumstances, storage of recreational vehicles in the CPD would be inconsistent with the Zoning Ordinance. However, the property has been used for several years as a contractor's storage yard and as such, the existing use is considered a legal non - conforming use and can continue. Staff is of the opinion that allowing the storage of recreational vehicles on the site on a temporary basis would be an extension of the legal non - conforming use and would not constitute an expansion of the use. Section 8113 -5.3.2 of the Zoning Ordinance states that a nonconforming use may be changed to a use that is similar, provided that it has a parking requirement which is the same as or less than the nonconforming use, except that the nonconforming use may not be changed to a use that requires a Conditional Use Permit. The Director of Community Development has determined that allowing a PP09228 :94 /9:22&nAA50C794.CC 1 00292 portion of the AC Construction site to be used for recreation vehicle storage is similar to the existing use on the site. On September 28, 1994, staff met with Council member Wozniak, Consultant John Newton, and Ed Tumbleson from the Sheriff's Department to formulate Conditions of Approval for a Temporary Zoning Clearance to allow temporary storage of recreational vehicles at the site. The following draft conditions have been formulated for the proposed temporary use: 1. The site is approved to be used as a temporary storage facility for the storage of recreational vehicles, as shown on the attached plot plan. The approval is for an initial period of 18 months with the ability to have one additional extension not to exceed 6 months. If the applicant intends to provide recreational vehicle storage beyond the 18 month period, the applicant shall apply for a Zoning Ordinance Amendment to allow recreational vehicular storage in the CPD zone and a Planned Development Permit. The application must be filed with the Department of Community Development prior to the termination of this Zoning Clearance. Upon application of a Zoning Ordinance Amendment and Planned Development Permit, the applicant will automatically be granted an additional 6 month extension, pending determination of the Zoning Ordinance Amendment and the Planned Development Permit. The applicant shall bear the total cost of staff time to process a Zoning Ordinance Amendment and Planned Development Permit. It is also understood that by issuance of this Zoning Clearance for the use of the property for the storage of recreational vehicles does not guarantee that the City will approve a Zoning Ordinance amendment for permanent use of recreational vehicle storage in the Commercial Planned Development (CPD) zone. 2. The authorized hours of operation shall be from 7:00 a.m. to 10:00 P.M. 3. There shall be no maintenance or repair of vehicles allowed on -site. 4. The storage area shall be paved with an all- weather surface to reduce dust emissions such as gravel, chip seal or other similar material as approved by the Director of Community Development. Prior to the issuance of the Temporary Zoning Clearance for the use of the site for temporary storage of recreational vehicles, the applicant shall pay for all staff costs for processing the permit. 6. No additional lighting is permitted on the premises without submitting of a photometric lighting plan and obtaining approval for additional lighting by the Director of Community Development. 7. Prior to use inauguration of the site for storage of recreational vehicles, the site shall be cleaned of all debris as determined by the Director of Community Development. 8. The applicant shall provide a security guard as determined by the Police Chief upon the first incident of theft or vandalism at the site. 9. That within 6 months of approval of the Temporary Zoning Clearance, the existing gas tanks shall be removed or deposed of in a method as approved by the City and the Department of Environmental Health Department. 10. On -site signs require approval of a sign permit from the Department of Community Development. 11. Unless otherwise determined by the Director of Community Development, the applicant shall provide a waste removal dumping station for the recreational vehicles within 6 months of approval of the Temporary Zoning Clearance. 12. Unless otherwise approved by the Director of Community Development, the storage of recreational vehicles shall be in an east -west orientation. This is to reduce possible vandalism. 13. The applicant shall keep the Police Department informed as to how they are to gain access to the property should the police need to enter the property. 14. The applicant is to submit a plot plan for review and approval by the Director of Community Development prior to issuance of the Temporary Zoning Clearance. The Director of Community Development intends to approve a Temporary Zoning Clearance for the use of the site for recreational vehicle storage on October 6, 1994. In the event the City Council wishes to review and /or amend the Director's decision, it should do so at the Council meeting of October 5, 1994.
