BACKGROUND
On June 27, 1983 DP-290, a 134,00 square foot industrial building located at 6101
Condor Drive, was approved by the County of Ventura; since this date the building has
been occupied by Litton Industries. At the beginning of this year, Litton Industries
vacated the subject site and relocated to Woodland Hills. While Litton was verifying that
the subject site was free from contamination, trace amounts of gasoline were found in
soil samples which were taken surrounding a six hundred(600) square foot building, see
attached.
The purpose of this staff report is to apprise the Council of Litton's intent to remove the
six hundred (600) square foot tilt up concrete building in order to test for soil
contamination underneath the subject building.
DISCUSSION
When the original Development Permit was approved by the County, the County approved
the installation of an underground fuel tank and an above ground six hundred (600)
square foot building which was to store flammable materials. This tank, was removed
on July 10, 1987, (see attached). When removing the tank, the soil surrounding the tank
was aerated to remove contamination due to leakage of fuel into the soil. Apparently,
when the soil was placed back into the ground after being aerated, the soil had not been
completely aerated in order to remove all contamination. Approval regarding the
completion of the required aeration was performed by representatives from the County
of Ventura.

Soil samples surrounding the area where the tank had been located indicate that the soil
is still contaminated by gasoline. However, without removing the building, it is
impossible to determine the amount of contamination and the required amount of
remediation; therefore, Litton Industries is requesting removal of the six hundred (600)
square foot building in order to test for contamination and to remove the contaminated
soil.
Based upon the knowledge of existing on-site soil contamination, Litton Industries is
required to prepare and circulate a Site Closure Plan to the City, County, and required
State agencies. The finalization of the Site Closure Plan is dependent upon the
determination that the contamination underneath and around the six hundred (600)
square foot building has been removed. Removal of the subject building will facilitate
the completion of the Site Closure Plan. When the Site Closure Plan is completed, all
appropriate agencies will review and comment on the closure plan and attend a briefing
meeting.
Staff has reviewed the initial conditions of approval for DP-290 and has determined that
granting of this modification will not be in conflict with the initial conditions of approval
(June 1983) or any subsequent conditions of approval established as a result of Minor
Modifications to Development Permit No. 290.
The Director of Community Development has reviewed the proposed Minor Modification
request and intends to approve the proposed request. The Director approved this permit
request on May 10, 1993, the appeal period will end on May 23, 1993. If no appeal is
made, the Director's decision will stand. Pursuant to Resolution
No. 88-523, the Director has the authority to approve Minor Modifications. This matter
is being presented to the Council as a courtesy. Should the Council or any interested
party wish to appeal the Director's decision, the next available public hearing date would
be June 16, 1993.

Receive and file this report.
