Mcc„„3 C=ant OF MOORPARK of - 2-- 199 ACTION: TO: Honorable City Council (1P f FROM: Dirk Lovett, Assistant City Engineer -..me /% DATE: January 25, 1994 (CC Meeting of 2/2/94) SUBJECT: Consider Authorizing Recordation of the Notice of Completion for Assessment District 92-1 (Phase 1) BACKGROUND: In January 1993 the City Council awarded a contract for the Assessment District 92-1 (Phase I) improvements to C.A. Rasmussen for the Contract price of $820,514.41 The project provides for the construction of roadway improvements on Park Lane and Lassen Avenue, water system improvements to service properties north of Los Angeles Avenue and storm drain improvements for Park Lane, Lassen Avenue and Los Angeles Avenue. In addition, street lights and electrical, telephone and cable television conduit were installed to service the properties north of Los Angeles Avenue within the Assessment District. DISCUSSION: Project construction, which began on May 17, 1993 , is now complete. The final construction cost is $855,913 .93 . A detailed cost summary is attached as Exhibit 1. As noted in that Exhibit, some of the Change Orders have not yet received final approval. Over the past several weeks the Contractor and the City have been discussing certain disputed work involving a number of issues summarized as follows: a) the transportation of earth removed from the trench required for the storm drain (initial potential claim amount: $12,000±) ; b) the reduced quantity of base material required for street construction (initial potential claim amount: $6,000±) ; c) delay costs for additional equipment storage time resulting from delays [see C. 0 #7 -- Exhibit 1] (initial potential claim amount $8,000±) ; d) interest on late payments (initial potential claim amount: $4,000±) . Rasmussen Project Completion February 1994 Page 2 Although it appears that we have come to agreement on item 'c' , the other matters remain unresolved and could eventually take the form of a claim for additional payment. At this time, it would be appropriate for the City Council to accept construction as substantially complete and authorize the recordation of the Notice of Completion to start the lien period prior to the release of the final retention. The Notice of Completion is attached a Exhibit 2. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1. Accept the work as complete. 2. Instruct the City Clerk to file the Notice of Completion. 3 . Authorize the release of the retention upon clearance of the thirty-five (35) day lien period. EXHIBIT 1 ( 1 of 2) FISCAL IMPACT 1 . A number of changes were required by the utility subsequent to the award of Contract. 2 Base Material Reduction: Contractor directed to reduce the depth of 0 base material used for roadway construction. This resulted in a savings of approximately $16,000 for this and related bid items. 3 Additional Paving Move-in: Park Lane and Lassen were paved ahead of 3,710.00 scheduled in order to meeting the schedule set for the K-Mart opening. 4 Raise Sewer Manholes: The plans did not include the work necessary 21,042.39 to adjust existing sewer manholes in Lassen Avenue subsequent to the construction of street pavement. Relocate Water Line at Shasta and L.A.Avenue: Design did not identify a conflict between the existing water utility and the new storm drain. 5 Various Work: a) Additional survey required to determine the amount 14,543.19 of unclassified excavation; b) Design did not call for required trenching for underground telephone utility; c) Additional storm drain construction costs due to changed conditions after award of contract; d) Relocation of sewer line serving the Gisler to eliminate conflict with storm drain. 6 Various Work: a) Additional work related to street lights which was ** 6,652.64 not included in the plans; b) Installation of crossover conduits prior to street paving; c) Install Road Closure fence at the west end of Lassen (not shown on the plans). 7 Delays: Costs for the additional storage of equipment resulting from ** 6,922.52 delays related to a) the construction of water system improvements and b) the relocation of a utility pole in Liberty Bell Road north of L.
