Aguilera, Director of Community Develo men ���� j ;c'.. ~` - Kathleen Mallory, Associate Planner v DATE: January 28, 1994 (CC meeting of February 2, 1994) SUBJECT: CONSIDER CERTIFICATION OF THE ATTACHED NEGATIVE DECLARATION AND APPROVAL OF INDUSTRIAL PLANNED DEVELOPMENT PERMIT NUMBER 93 -2 BACKGROUND Caltrans and the City have adopted a Memorandum of Understanding agreeing to cooperatively work to relocate the Caltrans Maintenance Facility to a site located east of the Minor Street and Fitch Avenue intersection (see Figure 1). The existing location of the Caltrans Moorpark Maintenance Facility is along the south side of Los Angeles Avenue west of Park Lane. That facility was constructed in 1946 and is considered by Caltrans to be antiquated. Prior to agreeing on the Fitch Avenue and Minor Street location, Caltrans approved the location of a new maintenance facility which would have relocated the Moorpark Maintenance Facility to a Caltrans owned site south of New Los Angeles Avenue and just west of State Route 23, at the entrance to the City. The City has pending litigation against Caltrans for use of the parcel adjacent to the Carlsberg property, because use of this site would have resulted in adverse visual, land use compatibility, and traffic safety impacts. The City has worked with Caltrans to find a more appropriate location for the Maintenance Facility. Permitting of the Fitch Avenue site will result in the termination of the pending litigation against Caltrans. The purpose of this staff report is to receive Council certification of the attached Negative Declaration and approval of the Industrial Planned Development permit for the proposed Maintenance Facility. DISCUSSION On February 2, 1994, the City Council will consider the acquisition of the Fitch Avenue property. The current plan is for the City to acquire the 4.15 -acre Fitch Avenue site (Assessor's Parcel Number 512 -0 -15 -515). Caltrans will then exchange the new Los Angeles Avenue site for the Fitch Avenue site. Carlsberg Financial Corporation will then purchase the New Los Angeles Avenue property from the City, and the State will construct the maintenance facility on the Fitch Avenue property. The attached plans show the proposed site, landscaping and building elevations. Given that a State Agency is exempt from the requirements of a Local Agency, staff has worked with Caltrans to The Honorable City Council January 28, 1994 Page 2 modify development plans to be substantially in conformance with the City's development standards. Staff will continue working with Caltrans on the design of the final site improvements. Environmental Document As part of the Environmental document, traffic, hydrology and soils reports were prepared for the subject site. Conclusions drawn from these studies indicate that no significant impacts will occur to the City's circulation and drainage system by the operation of the Maintenance Facility on the proposed site; a soils report prepared for the site notes that soil conditions are appropriate for the proposed project. Staff has received comments regarding the attached Negative Declaration. All of the comments have been addressed within the revised Negative Declaration and staff's response to the comments pertaining to the environmental document are attached to the Negative Declaration. The State mandated 30 -day review period began on December 28, 1993 and ended on January 27, 1994. No significant comments have been received. Pursuant to Section 15074 of the California Environmental Quality Act, no public hearing is required for a Negative Declaration. Industrial Planned Development For the Council's information, a State Agency is exempt from the regulations of a Local Agency; therefore, no conditions of approval are proposed. However, in an effort to build a project which is consistent with Moorpark's land development requirements, Caltrans has worked closely with staff on the design of the project. Though no Industrial Planned Development Permit is required, the City initiation of the permit is intended to document the Council's action on the project. Off -site Improvements No off -site improvements are proposed for the Caltrans Maintenance Facility, except for the construction of a portion of a public cul -de -sac on the northwesterly portion of land to be owned by Caltrans (at the terminus of Fitch Avenue). The construction plans for the cul -de -sac will be prepared according to City construction standards. ON THE CITY COUNCIL AGENDA OF FEBRUARY 2, 1994 BOX ITEM Attached, please find the plans for the construction of the Caltrans Maintenance Facility off of Fitch Avenue. The attached includes: a site plan, landscape plan with plant species plan, elevations, and a lighting site plan. Also attached for the Council's information, is a copy of the final Environmental clearance (Notice of Completion) received from the State of California. Though not noted on the lighting site plan, lighting poles to be installed are proposed to be 31 feet in height and 250 watt High Pressure Sodium. Staff is concerned with both the mounting height and the illumination level. Staff recommends a pole height of 25 feet and a reduction in the illumination level, to a maximum of 2 footcandles. Information regarding the lighting fixture and illumination levels has not been provided to staff. Staff intend to discuss the aforementioned matter with Caltrans at the next available meeting.
