Gilbert, Director of Public Works �( DATE: June 27, 1994 (Council Meeting 7-6-94) SUBJECT: Consider Authorizing Recordation of Notice of Completion for the Construction of the Arroyo Vista Recreation Center Buildings [Tri-Build Development, Inc. ] DISCUSSION As of the date of this report, the construction of the Arroyo Vista Park Community Center and Gymnasium is complete less minor corrections. The contractor did not complete the construction of the project within the time period required by the contract documents. Staff and the contractor have been and are continuing to discuss the impact of the late completion date on the City, its programs and its fiscal resources. A part of that consideration will deal with additional contract administration costs incurred as a result of the additional construction time. Those discussions do not prevent the City from accepting the project and recording the Notice of completion. It is, therefore, appropriate to direct the Notice of Completion to be recorded. It is recommended that the project retention be withheld until the issue of the late delivery date is resolved.
