Lindley, Assistant to the City Managerh fi DATE: June 30, 1994 SUBJECT: Consider Support for the City of Palmdale's Proposition 172 Amendment Request Background The City of Palmdale is requesting support from "low tax" cities for an amendment to Proposition 172. You may recall, Prop. 172 authorized the imposition of a half-cent sales tax to be redistributed to local governments for the purpose of public safety services. As approved, Prop. 172 revenue is redistributed to counties and cities that experienced a loss of property taxes during the 1993/94 State budget. It was promoted to cities and counties as a way to reduce the impact of the property tax loss. Since "low tax" cities, such as Moorpark and Palmdale, did not experience a loss of property taxes, they are not eligible for Prop. 172 revenue. The argument being made is that Prop. 172 was designed and promoted to the public as a way to enhance and increase all local public safety services. When the voters approve the proposition, they did so with the intent of improving public safety not with providing local government with a new discretionary revenue source. With this in mind, the revenue from Prop. 172 should be spent to benefit the jurisdiction in which it is generated. The City of Palmdale is requesting that the City support proposed legislation that would amend Prop. 172 to incorporate "low tax" cities into the revenue distribution formula. Specifically, the City is being asked to contact its State representatives to urge their support for the effort. Attached is the letter sent to State representives and the League of California Cities from the City of Palmdale. Recommendation Staff recommends that the City Council support the City of Palmdale's request, and direct the Mayor to prepare a letter to the City's State representatives urging their support for amendments to Proposition 172 .
