Consider Opposition to AB 3116 Exempting Schools
From Paying Solid Waste Franchise Fees
If approved, AB 3116 (Eastin) wou.,_d exempt school districts from
paying any solid waste surcharge, special disposal, household
hazardous waste, franchise, contract, or permit fees. In addition,
this bill exempts school districts from paying their fare share of
funding for a landfill's closure and postclosure maintenance, AB
939 activities, and countywide solid waste planning fees (CWIMp),
which all other solid waste generators must pay. School district
would be charged the cost of provi.ling actual solid waste service
only.
The City of Moorpark imposes a franchise fee and an AB 939 solid
Waste Management fee on all residential and commercial waste
generators. These fees offset the City's costs for administering
the solid waste contracts and provide for waste reduction and
diversion programs offered to residents and businesses. AB 3116
would exempt the Moorpark Unified School District and the Moorpark
College from paying these fees.
Staff and the League of California c ties recommend that the City
Council oppose AB 311(-).
Recommendation
Staff recommends that City Council oppose AB 3116 and direct the
Mayor to communicate the City position t,-3 the appropriate State
legislators and legislative committees,.
