DISCUSSION
On March 16, 1994, the City Councii approved submission of the
Ventura County National Pollutant Discharge Elimination System
(NPDES) Stormwater Discharge Permit Application. Said application
was submitted to the Los Angeles Regional Water Quality Control
Board (LARWQCB) by the Ventura County Flood Control District
(VCFCD) on behalf of the City of Moorpark and the other Co-
Permittees. A copy of the Fini1 Permit Application was made
available to the City Council for review and has been filed in the
Office of the City Clerk.
Attached is a copy of the final draft Permit from the LARWQCB. it
is the intent of that Board to ,ssue this permit in late July.
Said permit, and the related permit application, places certain
obligations upon all of the co- permittees, including the City of
Moorpark. Many of those obligations require a commitment of
resources. An estimate of the fiscal impact of complying with the
requirements of the program werr set forth in the March staff
report to the City Council.
The purpose of this report is to advise the City Council of the
intent of the LARWQCB to issue th- attache Permit.
RECOMMENDED ACTION

The Ventura County Flood Control Dis-mi t (VCFCD), the County of Ventura, and the
Cities of Camarillo. Fillmore, Moorpark. )jai. Oxnard. Port Hueneme, San
Buenaventura, Santa Paula. Simi Valle,,, nd "housand Oaks (hereinafter referred to
separately as Co- Permittees and jointly a� the Discharger) have joined together to form
the Ventura Countyxx -ide Storm Water Nl i is <aement Program, and petition to be
covered by a single National Pollutant Di� charge Elimination System (NPDES) permit
for publicly m%ned municipal storm c11rain in 'v'entsra County under their jurisdiction.
'. The Discharger submitted a two -part pern ,t application (hereinafter called the
Application) to the Regional Board for . ,, _lance of waste discharge requirements under
the NPDES. Part I of the application vvas submitted on January 19, 1994, and Part 2
was submitted on April 1, 1994. This .ArI iication included all the Co- Permittees
except the Cit% of Oxnard, which had "ittcd ,ts ),wn Part 1 permit application on
May 18. 1992, and Part 2 on May I-
3. The applications submitted by the Discharger, the City of Oxnard, and the City of
Thousand Oaks are collectively referred tt as the Application Package. The

information contained in the Application Package is generally found by the Regional
Board to satisfy EPA's NPDES permit ap; licatior: requirements for municipal storm
wafer discharges
4. In the Application, the Discharger propose j the Ventura County Storm Water
Management Plan (hereinafter called the 11an) which describes in detail all group
activities and entity- specific activities. Jhc Plan also describes measures that are
included and how they are organized; it Ir is tasks required to accomplish the
measures. the schedule for implementation and specific goals. The schedule and tasks
are projected for the 5 -year permit perwc _' \r of the Plan is presented in
Table 1.

5. A two hundred and eight square mile arc, including all the cities as well as
unincorporated areas of Ventura County ,: Ained as urban by the LT. S. Census Bureau,
is subject to the permit requirements. Tae area is diti'ided into four drainage zones
based on their flow patterns. Each zone i. a separate major watershed consisting of
incorporated cities and unincorporated lams (Figure 1). Zone 1 is the Ventura River
watershed, which contains the Cite or (fit:i. a portion of the City of San Buenaventura,
and unincorporated county lands. Zone 2 7 the Santa Clara River watershed containing
the Cities of Oxnard, Port Hueneme, Santa Paula, and Fillmore, parts of the Cities of
San Buenaventura and Camarillo, and tanijtcorporated county lands. Zone 3 is the
Calleguas Creek Natershed, containing ihL Cities of Simi Valley, Moorpark, Thousand
Oaks, and Camarillo, and unincorporated .. ounty lands. Zone 4 contains a portion of
the City of Thousand Oaks and the rc'maii :in,2 unincorporated portion of the county not
contained in the other zones.
6. Approximately nine square miles of tale l n of Thousand Oaks are tributary to Malibu
Creek in Los Angeles County, and ultimaiel-, io Santa Monica Bay. The City of
Thousand Oaks initially applied for a sepz� rate NPDES permit for this portion of the
city and submitted their NPDES apphcatik n Part I in tilarch 1992, and Part 2 on
March 25, 1993. To avoid duplication cart -,porting requirements, the Citv of Thousand
Oaks. including the portion tributary io \1 ilibu l re k. became a single Co- Permittee
under the Ventura County NPDES pern i
7. The Co- Permittees are separate legal eniit,�s and have the authority to develop,
administer, implement, and enforce storin .eater management programs within their
own jurisdiction. Each Co- Permittee separ ,tel% and the Discharger shall be responsible
for compliance with rele,'ant portions W 1 Gs permit
8. The Water Qualitv Act of 1987 added Se,- on 402(p) to the Federal Clean Water Act
(CWA). This section requires the Unitec: ',tates Environmental Protection Agency
(EPA) to establish regulations setting fwirt '.NPDES requirements for storm water

discharges. The first phase of these requirements is directed at municipal separate

storm drainage systems serving a populati, n of 100,000 or more and storm water

discharges associated with industrial activi ies. including construction activities. Other
dischargers, including municipalities with ,: population of less than 100,000, for which
the EPA Administrator or the State deteirrrInes that the storm water discharge
contributes to a N iolation of a water qua,it standard, or is a significant contributor of
pollutants to waters of the United States i.,a% also l :�e subject to NPDES requirements.
On November 16, 1990. EPA published th- -se final regulations in the Federal Register
under Part 122. For municipalities sera i n� a population greater than 100,000, the

16. The Regional Board intends to require a ,� parate NPDES permit for, or to modify this
Order to include as a Co- Permittee, any date and Federal agency, facility and entity
(such as Caltrans. college campuses, ho,pr als, or parks), agricultural areas, real estate
developments, waste disposal facilities. ctc . as necessary. Pursuant to 40 CFR
122.26(a), the Regional Board will give tfi.�se entities the option to become Co-
Permittees or obtain individual storm - %,!tc dis:harg�..� permits.

The Board has notified the Discharger and s.CG agencies and persons of its intent to
issue waste discharge requirements for this discii -rgc. ar..i has prov ided them with an
opportunity to submit their written views and r Inn end�.tions.
The Board, in a public hearing, heard and ccnsio red all c mments pertaining to the discharge
and to the tentative requirements.
This Order shall serve as a National Pollutant Di,,charge Elimination System (NPDES) Permit,
pursuant to Section 402 of the Federal Clean Waller Act. or amendments thereto, and shall
take effect at the end of ten daN s from the data its adoption provided the Regional
Administrator of the EPA has no objections

implementation of control measure, and otter actions to reduce pollutants in
the discharge as proposed in the Plan and an°v subsequent approved
modifications, revisions, or amendments, As such, the Plan submitted by the
Discharger is an integral and enlor..;eable component of this Order. Each of the
Co- Permittees need only comply \� ith permit conditions ("including Discharge

Reporting Requirements
A. The Discharger shall develop, and submit io ne Regional Board by March 1, 1995, an internal
audit program to ensure a timely and conwrc 7ensrve implementation of the Plan by each Co-
Permittee. The Principal Pennittee shall be r, >ponsible o carry out such a program and report
to the Regional Board the result of the audit n the anrural report.
B. The Discharger shall submit, by March 1 t acii Near. I semi - annual progress report
documenting the progress of the implemert:a OF of the Plan.
C. The Discharger shall submit, by Septembe of each %car, an annual report documenting the
status of all the general program and 111(11\ id lal tasks contained in the Plan. The annual report
shall be a detailed compilation of all the aei,,erables and milestones completed as described in
the Plan. On an annual basis, each Co -Perms tee shall : mduct an evaluation of the
effectiveness of its scheduled activities is do ,cribed in he Plan. Measures of effectiveness
include, but are not limited to, quantitati�t 1 onitonng ':.o assess the effectiveness of control
measures, detailed accounting of` program ia:. oniplishm--nts, funds expended, and staff hours
utilized. This annual report shall provide in verall evaluation of the program and set forth
plans and a schedule of implementation tt , e ol>com tg year.
D. All applications, reports, or information subs itted t o the Regional Board shall be signed and
certified pursuant to EPA regulations 4( ( I' I ': I

A. For each drainage zone, the Discharger shall ,ubmit to the Regional Board all water quality
data and flow data from 1980 to the present o facilitate identification of sources of pollutants
present in discharges from the areas subject o the requirements of this permit. These data

and by September 18, 1994, for Drainage Z te I

Ventura County Flood Control District, the C)urtN of Ventura, and the Cities of Camarillo,
Fillmore. Moorpark. Ojai. Oxnard. Port Hueneme San Buenaventura, Santa Paula, Simi Valley,
and Thousand Oaks have joined together to form the �'entL ra Countywide Stormxvater Quality

Elimination System permit for publicly owned im ;•aiclpal storm drains in Ventura County under
their jurisdiction.
Ventura County Flood Control District submitted a two -par! permit application to the Regional
Board for issuance of waste discharge requiremen s under t "e NPDES. Part 1 of the application
was submitted on January 19, 1994, and Part x�a.., submitted on April 1, 1994. This Application
included all the Co- Permittees except the City >t Oxnard. which had submitted its own Part 1
permit application on May 18, 1992, and Par M.ry l " ', 993.
On the basis of preliminary staff review and apple, ation of lawful standards and regulations, the
California Regional Water Quality Control Board Lips Angeles Region, tentatively proposes to
issue waste discharge requirements, including efflu,..!rrt limitations and special conditions. Written
comments regarding this tentative order must F.- receive -'i by July 8, 1994, in order to be
considered by the Board and included in the lioar,fs aLenda folder. Submittal of written
comments is encouraged to ensure that all commcnts will be included in the record before the
Board. A public hearing will be held by the koard on lulu 18, 1994, at the City of San
