SUBJECT: AMENDMENTS TO THE CAR&BERG SPEdiFIC PLAN
Background
At the City Council meeting of August 1, 1994, the City Council
directed staff to make Council directed modifications to the Draft
Resolutions, Specific Plan, Mitigation Monitoring Program, and the
Ordinance amending the City's Zoning Regulations in order to adopt
the amended land use regulations of the Specific Plan as Zoning for
the property. The Council directed staff to bring this matter back
to the City Council on September 7, 1994. The changes to the
Specific Plan were made by consensus of the City Council:
1. The ultimate width of Spring Road br e -to be designed
with an ultimate width of 52 feet which will consist of
12 feet for each travel lane (24 feet total), 5 feet for
each bike lane (10 feet total), 4 feet for the median,
and 5 feet for each sidewalk (10 total) and the remainder
to be allotted for the walls on the bridge.
2. The section entitled Street Improvements was changed to
accept Areas C and D in both of the areas and items
making references to the four TC's were eliminated.
3. The Section entitled Tierra Rejada Area of Contribution
Fee - EIR Mitigation Measures was eliminated and combined
with Item 3.B.
4. By Consensus, the Council made the determination to
modify the following wording as described by
Councilmember Montgomery: Item l.a, Page 31 entitled
Single Family Detached - Areas A, B, and D - deleted the
word "concrete" to have it read: "The roof tiles and
Stucco colors, as well as ... " . ; Page 33 entitles "Roofs"
- Added a section to discuss tile, changes to read
"mandatory" roof colors instead of "preferred roof
colors ", and added a section entitled "Styles ".

5. Deleted the first section on page 62 titled "Neighborhood
Park (P) ", but retained the second section I titled "Open
Space (OS) ".
6. Elimination of TC 17 which required the applicant to
contribute fair share of the costs (through funds
partially contributed by the proposed project or
applicant payment of additional AOC or Proposition 111
fees) should a traffic signal be installed at the
intersection of Moorpark Road /Tierra Rejada Road as part
of the AOC widening project.
In addition, several other necessary minor verbiage changes were
made tethe Specic Plan which have been placed in Legislative 01:
format for the Council's information.
Staff has completed the draft Ordinance amending the Zoning for the
property and amending the Zoning Ordinance. The draft Ordinance
was previously sent to the City Attorney for review. Appropriate
changes to the Ordinance have been completed and is attached for
the Council's review.
Recommendations:
1. Review the amended Draft Resolutions, Specific Plan,
Mitigation Monitoring Program, and Ordinance.
2. Adopt the Resolution Certifying the Environmental Impact
Report inclusive of the Project Modification Summary and
approve the Mitigation Monitoring Program .
3. Adopt the attached Resolution and findings and statement of
overriding considerations amending the Land Use Element of the
General Plan to reflect the amended land uses
4. Introduce for first reading the Ordinance to amend the
Property's Zoning and City's Zoning Regulations in order to
adopt the amended land use regulations of the Specific Plan
and Zoning for the property.
