Gilbert, Director of Public Works DATE: July 22, 1994 (Council Meeting 8 -3 -94) SUBJECT: Consider Resolution No. 94 - Establishing Certain Parking Restrictions on the South Side of Los Angeles Avenue between Moorpark Avenue and Park:L-anw_­<.c.• OVERVIEW This presents a Resolution establishing certain parkin restrictions on the south side of Los Angeles Avenue betwe Moorpark Avenue and Park Lane. 'i-A DISCUSSION A. Overnight Parking of Trucks The dirt shoulder area on the south side of Los Angeles Avenue between Moorpark Avenue and Park Lane is used for the parking of large trucks and semi -truck and trailers to allow drivers to use the commercial services located at the Moorpark Town Center. It has been observed that some trucks park in this area for an extended period of time late at night and through the early morning hours using the area as an overnight rest stop. B. Transportation & Streets Committee At a recent meeting of the Transportation and Streets Committee (Mayor Pro tem Hunter and Councilmember Wozniak) it was recommended that staff pursue efforts necessary to prohibit the overnight parking of all vehicles along this dirt shoulder area. C. Private Road It appears that the subject dirt shoulder area may be located south of the state highway right -of -way, and may, therefore, be considered a private road. Section 21107.5 of the California Vehicle Code provides for the establishment of parking restrictions on a private road, subsequent to a public hearing for which notice, given at least ten (10) days prior to the scheduled public hearing, has been given to the owners of the properties affected. eslel —prk Los Angeles Avenue Parking August 1994 Page 2 CVC Section 21107.5 (c) requires the City Council to hold a public hearing and give at least a ten (10 ) day notice of said hearing to the owners of the affected properties. Such a notice was sent. Subsequent to the public hearing, the City Council may adopt a resolution imposing parking restrictions on a private road, even if the property owner(s) object. However, if an owner erects a sign in accordance with the requirements set forth in CVC Section 21107.5 (b), stating that the road is privately owned and maintained and that it is not subject to traffic regulations or controls, the resolution becomes unenforceable. 1. NO STOPPING -- In November of 1991, the City Council adopted Resolution No. 91 -818 establishing a number of parking restrictions including a NO STOPPING ANYTIME zone on the south side of Los Angeles Avenue from a point one hundred feet east of Park Lane, westerly to a point west of Butter Creek Road. This NO STOPPING restriction applies to the frontage of the Circle -K property. It is recommended that another NO STOPPING ANYTIME zone be established on the south side of Los Angeles Avenue from Moorpark Avenue westerly to a point approximately two hundred fifty feet (2501) west of Moorpark Avenue. This restriction will ease congestion near the intersection of Los angeles Avenue and Moorpark Avenue. The limits of this additional parking restriction is also coincidental with the limits of the street improvements required by the future development of the property at the southwest corner of Moorpark Avenue and Los Angeles Avenue. 2. NO PARKING 10:00 P.M. TO 5:00 A.K. -- It is recommended the remaining area between Moorpark Avenue and Park Lane be designated NO PARKING 10: p.m. to 5:00 a.m. in order to prevent the overnight parking of large trucks. ssls3 —prk Los Angeles Avenue Parking August 1994 Page 3 F. Staff Review The City Attorney and the Deputy Chief of Police were provided earlier drafts of this resolution and have provided input to the author regarding the proposed action. G. Caltrans Approval In accordance with applicable CVC requirements, it is proposed that the parking restrictions set forth in the attached resolution be approved by Caltrans.
