Traffenstedt, Senior Planner August 5, 1994 (CC Meeting of August 17, 1994) SUBJECT: CONSIDER ADOPTING A RESOLUTION RESCINDING RESOLUTION NO. 85 -209 AND ESTABLISHING NEW GUIDELINES FOR THE SCREENING OF GENERAL PLAN AMENDMENT REQUESTS Background Resolution No. 85 -209 was adopted by the City Council on June 27, 1985, and revised guidelines for the screening of General Plan amendments (Attachment 1). Staff is proposing minor amendments to the criteria used by the City to deny or approve the processing of a General Plan amendment request, as discussed below. Discussion The revisions proposed by staff to General Plan amendment request screening criteria are primarily editorial. Attachment 2 to this report is a proposed draft resolution which contains staff's recommended screening criteria. The revised criteria are shown below in legislative format to identify the changes made to the screening criteria. Proposed new language is shown by a shaded "redline" format, and text proposed to be deleted is identified by the "strikeout" format. As can be seen by the proposed text revisions identified above, the only substantive change is the addition of approval screening criterion No. 4. Draft Resolution dst- 08- 5- 9413: 30pmC :\WP5I\STFRPT\CCB- 17GP.RSS ATTACHMENT 1 RESOLUTION NO. 35 -209 A RESOLUTION OF THZ CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING GUIDELINES FOR THE SCREENING OF GENERAL PLAN AMENDMENTS WHEREAS, Government Code Section 65300 directs the adoption of a comprehensive, long term General Plan for the physical development of the City; and WHEREAS, the City Council has adopted two of the nine mandated elements of the General Plan; and WHEREAS, Section 65351 provides for the amendment of the General Plan; and WHEREAS, the City Council.' deems it desirable to screen requests for amendments to the General Plan and to adopt criteria for such screening; f NOW THERF,FORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESOLVES AS FOLLOWS: SECTION" 1. The'following criteria will be used by the City Council in denying the processing of General Plan Amendmenu requests: 1_ When the proposed amendment request shares significant similarities with other amendments located in the same ;general area which have been previously considered and denied by the City Council within the last 12 months. 2. When the proposed amendment request site is located in an area where the Council has directed the preparation of a land use study scheduled for a public hearing within the next 11 months. 3. When the proposed amendment request would create an "island" or spot land use designation inconsistent with -the intent and policies of the General Plan, and density or land uses of surrounding properites. SECTION 2. The following. criteria will be used by the City Council in improving the processing of General Plan Amendment requests: 1- When the proposed amendment request has a potential for — - conformity with applicable gt)al -s and po -licies of the General Plan. - — - - - - 2. When the proposed amendment request has a potential ( for compatibility with either existing or planned uses in the area. 3. When the proposed amendment request has the potential for conformity with other City Council adopted policies. SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution. PASSED AND ADOPTED this 17th day of June , 1985. MAYOR ATTEST: CITY CLERK
