Baldemar Troche, Public Works Management Analyst DATE: August 5, 1994 (CC Meeting of August 17, 1994) SUBJECT: Traffic Speed Study OVERVIEW Presented herewith is a Traffic Speed Study prepared by the City's consultant for certain designated streets within the City. On the basis of this study, it is recommended that the posted speed limits on certain streets be revised and /or re- affirmed by City Council Resolution. DISCUSSION A. Background Section 40802 of the California Vehicle Code requires, as a prerequisite to the enforcement of any speed law with radar, the preparation, within the past five years, of a traffic speed survey. On July, 1990, City Council adopted Resolution No. 90 -701 approving a Traffic Speed Study and enacting certain specified speed limits for certain designated streets throughout the City. That report, and any supplements thereto, enabled the City to use electronic radar devices in the enforcement of speed laws. Although the validity of the 1990 report will not expire until October 1995, the condition on many of these street segments have changed. B. 85th Percentile Speed Staff has been informed by the Sheriff Department that they are unable to use radar to enforce speed violations on certain street segments because the courts have invalidated citations based on speed studies where the posted speed limit is more than 5 MPH less than the 85th percentile speed as reflected in the speed study. The only legitimate exception to this provision which would allow the posting of a speed limit more than five miles per hour (5 MPH) less than the 85th percentile speed, is the existence of conditions which are not readily apparent to the driver. \signs \spd_4_94.rpt Speed Survey Page 2 C. New Study On April 20, 1994, the City Council approved the selection of a consultant to prepare a new Traffic Speed Study for the City. That Traffic Speed Study has been completed and a final draft has been placed in the City Council office for review. Mr. Paul Singer of Traffic Counts Inc., will be available at the City Council meeting to describe, if necessary, the methods and procedures used to prepare the Speed Survey and to answer any questions of the City Council. A summary of the Speed Survey is attached as Exhibit 111. D. Committee Review On August 4, 1994, the Transportation and Streets Committee (Mayor Pro -tem Hunter and Councilmember Wozniak) discussed the matters set forth in this report. At said meeting, the Committee concurred with staff's recommendation to adopt two separate Resolutions as described in section E and F of this report. Section 22357.1 of the California Vehicle Code allows for the posting of 25 MPH signs at parks. It is the intent of staff to post such signs at all City parks located on all streets which do not have a current Prima Facie speed limit of 25 MPH such as streets adjacent to Campus Canyon Park and Peach Hill Park. Once said signs have been posted along Hearon Drive and Peach Hill Road, staff will have the City's consultant re- survey those street segments listed in Exhibit 13' to determine the 85th percentile speed. The Committee recommended that the posted speed limits listed in Exhibit 131 be re- considered subsequent to this re- evaluation. E. Enactment of New Speed Study The Resolution attached as Exhibit 12' rescinds prior Resolutions pertaining to speed limits on the majority of the street segments in the Speed Survey and re- establishes speed limits for those street segments based on the findings of the new Speed Survey. Upon adoption of this resolution and the posting of new speed limit signs where necessary, the Sheriff's Department will be able to use radar to enforce these new speed limits.
