SUBJECT: CONSIDER ORDINANCE NO. - AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
AMENDING SECTION 2.12.1201, PROVIDING THAT WRITTEN
CONTRACTS MADE OR ENTERED INTO BY THE CITY MAY BE
SIGNED BY THE CITY MANAGER AS AN OFFICER OF THE
CITY.
BACKGROUND
Ordinance 139, codified as 2.12.120 of the Moorpark Municipal Code,
authorizes that the City Manager may execute contracts up to a
maximum of $25,000 for which a budget appropriation has already
been approved by the City Council. The ordinance also provides
that contracts so executed are scheduled on the agenda for the
Council's information.
In an effort to simplify internal processing and shorten the length
of the agenda, staff is proposing that Section 2.12.120 be amended
to allow contracts executed by the City Manager or his designee to
be presented to the Council for their information via a monthly box
report. The proposed amendment also provides that the City
Manager's designee be authorized as approved by the City Manager to
execute contracts up to a maximum of $5,000 for which a budget
appropriation has already been approved by the City Council.
Recreation service contracts that contain standard boiler plate
language and allow, as the only discretion, latitude in insurance
and standard City contracts with no deviation is an example of the
contracts a department head would be designated to sign. At the
City Manager's discretion, each designee would be limited in
authority to a per contract or per annum cap which would not
necessarily be $5,000 but in any case not exceed $5,000. It's the
City Manager's intention that all or most of the contracts to be
signed by others so authorized be a pre- approved City standard
contract.
In accordance with adopted procedure, the draft ordinance has been
reviewed by the City Attorney.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF MOORPARK, CALIFORNIA,
AMENDING SECTION 2.12.120, PROVIDING
THAT WRITTEN CONTRACTS MADE OR
ENTERED INTO BY THE CITY MAY BE
SIGNED BY THE CITY MANAGER AS AN
OFFICER OF THE CITY.
WHEREAS, General Government Code Section 40602 states that the
legislative body may provide by ordinance that written contracts
made or entered into by the city may be signed by an officer other
than the mayor; and
WHEREAS, it is administratively expeditious that the City Manager
be authorized to sign certain contracts;
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. That Section 2.12.120 of the Moorpark Municipal Code
is hereby amended to read:
Section 2.12.120 Authorit to sign written contracts.
A) The City Manager may execute on behalf of the City any
contract which has received prior approval of the City
Council.
B) The City Manager shall be authorized without prior
approval to execute contracts up to a maximum of $25,000
for which a budget appropriation has already been
approved by the City Council.
C) The City Manager's designee shall be authorized without
prior approval to execute contracts up to a maximum of
$5,000 for which a budget appropriation has already been
approved by the City Council.
D) A list of contracts executed by the City Manager and /or
his designees pursuant to 2.12.120 (B) and (C) shall be
presented to the Council for their information via a
monthly report. A contract will be so presented within
one month of its execution.
SECTION 2. The City Clerk shall certify to the adoption of this
ordinance and cause the same to be published in the manner required
by law.
