Background The City Council certified the original EIR and approved this project (known as CPD 89-1, 89-2 and LDM 89-2) on October 17, 1990 . Discussion On November 6, 1992, Carl Karcher Enterprises, Inc . applied for Minor Modification No. 4 to Commercial Planned Development Permit 89-1 and -2 for approval to construct a drive through restaurant with an outdoor play area. The proposed restaurant without the proposed outdoor play area was approved in concept with the approval of CPD 89-1 and -2 . The proposed building will be a single story, 3,035 sq. ft. building with 92 proposed seats inside with 42 patio seats . The proposed restaurant will provide approximately 13,004 square feet of landscaping. A 3' high landscape buffer to partially screen the drive through area from Los Angeles Avenue will be provided adjacent to the drive-thru area. Access to the restaurant will be from the shopping center main entrance along Los Angeles Avenue. The proposed Carl's Jr. Restaurant, as proposed will include the following: Site Area 30,700 sq. ft. Landscaping Area approximately 13,004 sq. ft. Parking Spaces Provided 60 spaces Parking places required 31 spaces The proposal meets or exceeds all development standards set for this site by the Zoning Ordinance. The proposal will be an attractive addition to the Mission Bell Plaza Center. PP11:12:92/4:16pmA:\MINMOD4.CC 1 Proposed Play Area The proposed play area will be covered with a wood lattice patio cover to screen the top of the play area so as to partially screen it from Los Angeles Avenue. Elevations Staff required that the elevations maintain the architectural style of the existing shopping center to better reflect a Mission style architecture. The Director of Community Development has reviewed the proposed Minor Modification and plans to Conditionally approve it. Pursuant to Resolution No. 88-523, the Director has the authority to approve Minor Modifications . This matter is being presented to the City Council as a courtesy. In the event the City Council wishes to appeal the Director's decision, it may do so. Should the City Council desire to appeal, it should set a public hearing date. The next available meeting date would be the regular meeting of April 7, 1993. If the City Council takes no action, the Director's decision will stand. Recommendation Receive and File Attachments: 1. Plot Plan and Elevations PP11:12:92/4:16pmA:\MINMCD4.CC 2 THE FOLLOWING CONDITIONS FOR CPD 89-2 MINOR MODIFICATION NO. 4 - SHELL OIL IS IN ADDITION TO THE CONDITIONS FOR CPD 89-1 AND -2 1. Signs shall be consistent with the approved sign program for Mission Bell Plaza. 2 . The monument sign shown on the proposed plans is not allowed by the sign program for Mission Bell Plaza. 3 . Not more that two wall signs may be located on any of the elevations. 4 . The colors of the playground equipment shall be light tan and beige as evidenced by the color chips and samples submitted. 5 . No signs or logos may be displayed on the canopies.
