SUBJECT: CONSIDER ADOPTION OF A RESOLUTION CERTIFYING THAT THE
CITY OF MOORPARK HAS NO AT -RISK "ASSISTED HOUSING
DEVELOPMENTS" PURSUANT TO GOVERNMENT CODE SECTION
65583(a)(8)
BACKGROUND
Section 65583(a)(8) of the Government Code pertains to housing
element content and requires local jurisdictions to analyze and
develop a program for preserving "assisted housing developments"
eligible for conversion. "Assisted housing developments" are
defined as multifamily rental housing that receives governmental
assistance under federal programs listed in Government Code Section
65863.10(a), state and local multifamily revenue bond programs,
local redevelopment programs, the federal Community Development
Block Grant Program, local in -lieu fees, and multifamily rental
units that were developed pursuant to a local inclusionary housing
program or used to qualify for a density bonus pursuant to
Government Code Section 65916.
The purpose of the required analysis of "assisted housing
developments" is to identify actions (programs) the jurisdiction
can take to preserve at -risk units, to adequately plan for
preventing or minimizing tenant displacement, and to preserve the
local affordable housing stock.
Jurisdictions which do not have any affected projects and do not
choose to amend their housing element prior to the next required
update (July 1994 for Moorpark), are permitted to submit a finding
adopted by resolution of the legislative body. The finding must
include a description of the process used, sources contacted or
factual basis for the finding of no affected units, and the
checklist from the State Department of Housing and Community
Development technical assistance paper, Housing Element Analysis:
Preservation of Assisted Units.

DISCUSSION
The Community Development Department has completed an analysis of
"assisted housing developments" in the City of Moorpark, and we
have concluded that there are no at -risk units during the ten -year
analysis period (between July of 1989 and July of 1999). A draft
resolution is attached to this report which includes the State
Department of Housing and Community Development (HCD) Checklist.
Staff faxed a copy of the draft resolution and checklist to HCD
staff for their review. The HCD Division of Housing Policy
Development has made a preliminary determination that the attached
resolution is prepared consistent with Government Code Section
65583(a)(8) requirements.
RECOMMENDATION
Adopt a resolution certifying that the City of Moorpark has no at-
risk "assisted housing developments" pursuant to Government Code
Section 65583(a)(8).
