Aguilera, Director of Community Development7/' Kathleen Mallory Phipps, Associate Planner l,, J June 8, 1993 (CC meeting of June 16, 1993) SUBJECT: CONSIDER THE APPEAL OF THE DIRECTOR'S DECISION TO DENY THE CARLSON COMPANY'S REQUEST (DP -980, MINOR MODIFICATION NUMBER 4) TO ERECT A TWENTY -FOUR (24) FOOT TALL PYLON SIGN ON LOS ANGELES AVENUE FOR THE HUGHES CENTER, KNOWN AS THE TOWN CENTER BACKGROUND Representatives from the Carlson Company, the Management Company for the Town Center have proposed the attached Sign Criteria. Part of the proposed modification to the existing Sign Criteria included a request to install three Monument Signs and one Pylon Sign. Two of the proposed Monument Signs would be located on Los Angeles Avenue, one advertising the Coffee Grinder and the other advertising Hughes and Thrifty's; the other Monument Sign would be located on Moorpark Avenue and would advertise Hughes and Thrifty's. The proposed Pylon Sign would be located on Los Angeles Avenue and would be twenty -four (24) feet by ten (10) feet. At the Council meeting of May 19, 1993, the City Council was apprised of the Director's decision to conditionally approve the request by the Carlson Company. One of the conditions of approval was that the proposed plan to erect a twenty -four (24) foot tall Pylon Sign for the Town Center, Hughes Center, was to be deleted from the sign program. Pursuant to Resolution Number 88 -523, the Director has the authority to approve, conditionally approve or deny Minor Modifications. The City Council, however, has the authority to appeal the Director's decision. At the May 19, 1993 meeting the City Council decided to appeal the director's decision to conditionally approve the Minor Modification with the requirement to delete the Pylon Sign. A public hearing has therefore been set in compliance with City policy. KMP- 06- 08- 93(10:35am )A: \CC6- 16C.RPT The Honorable City Council June 8, 1993 Page 2 At the May 19, 1993 meeting, a representative from the Carlson Company, indicated that they would be willing to eliminate one of the two Monument Signs to be located on Los Angeles Avenue (the Coffee Grinder Monument Sign) in order to receive Council approval of the Pylon Sign. DISCUSSION The Carlson Company has requested conceptual approval of a Pylon Sign to be located on Los Angeles Avenue, see Exhibit A. Those businesses advertised on the sign will be Hughes and Thrifty's. As indicated during the City Council's May 19, 1993 meeting, the Director of Community Development did not approve the Pylon Sign based upon the following: The Monument Signs on Los Angeles Avenue and Moorpark Avenue, in addition to the existing on -site lettering height of seventy -two (72) inches, will be sufficient to increase the visibility in the form of signage for Hughes and Thrifty's. As proposed, the Pylon Sign will advertise Hughes and Thrifty's. Combined with the seventy -two (72) inch letter height and Monument Signs for the Center, the erection of a Pylon Sign advertising Hughes and Thrifty's, will result in excessive signage for the Center. Additionally, the Center is well established and has been successful without the additional signage. During the Council's meeting of May 19, 1993 the Council discussed establishing two classifications of Major Tenants based upon building square footage. As proposed by the Council, Major tenants with 6,000 to 12,000 square feet of building area would be allowed a four (4) foot wall sign and additional advertisement on the Pylon Sign. Major Tenants, as currently outlined within the Sign Criteria, with more than 12,000 square feet of building area would be allowed a wall sign six (6) feet in height and advertisement on the Pylon Sign. Determine that the proposed Minor Modification is categorically exempt pursuant to the California Environmental Quality Act (CEQA) as a Class 1 (Section 15301) exemption for minor alterations. 3. End Unit - A building whose has two primary elevations, usually located at the end of a row of shops. The Director of Community Development shall determine which shops meet this criteria. 2. Logo - As defined in the City of Moorpark's Zoning Ordinance; however it is not required to be a registered logo. 3. Freestanding (Out Parcel) Tenant - A tenant occupying lease space in a freestanding building on a pad separate and apart from major and other in -line tenants. 4. Major Tenant - A tenant occupying lease space equal to or greater than 6,000 square feet. S. Minor Tenant - A tenant occupying lease space equal to or less than 5,999 square feet. 6. Monument Sign - A free standing sign, other than a pylon sign, no taller than five (5) feet in height. 7. Painted Sign - Signs painted directly on the exterior surface of a building or structure. 8. Primary Sign - Consists of the name of the Company, Corporation, Business or Organization doing business at this location. 9. Pylon Sign - A free standing sign, the supports or uprights and structure of which have received architectural enhancement. 10. Secondary Sign - Consists of name of specialized department or services being conducted within a Company, Corporation, Business or Organization doing business at this location. 11. Sign - Any device or part thereof capable of visual communication or attraction including any announcement, declaration, association, corporation, institution, organisation, product, service, event, location or other business entity by any means, including words, letters, figures, design, symbols, fixtures, colors, illumination or projected images. "Sign" shall not include any official notice, directional, warning, or information signs or structures issued by any federal, state, county or municipal authority. 12. Sign Maintenance - The repairs of faded, broken or electrical components of a sign. 13. Trademark - As defined in the City of Moorpark's Zoning Ordinance; however, it is not required to be a registered trademark. 14. Wall Signs - Signs which are in any manner affixed to any exterior wall of a building or structure, the exposed face of which is in a plane parallel to the plane of the wall and which projects not more than eight inches from the building or structure wall. Town Center, Sign Program, May 11, 1993 Page 4 15. Window Signs - Signs painted, attached, glued or otherwise affixed to a window or otherwise easily visible from the exterior of the building. General Requirements 1. Purpose: The purpose of the following criteria is to establish a coordinated sign program that gives each tenant adequate identification, while achieving a unified, attractive appearance among all lease spaces. In order to maintain the integrity of the criteria and equity among all tenants, deviations from the criteria will not be approved. 2. Existing Signs: Upon enactment of this criteria, all existing signs which do not meet this programs criteria at this center shall be considered legal non - conforming signs and shall be allowed to be maintained (see Sign Maintenance, definitions) until tenant vacates lease space. 3. Exceptions: All exceptions to these criteria must be approved by the landlord and City of Moorpark Director of Community Development. 4. Landlord Approval: Prior to sign fabrication, the tenant shall submit three (3) copies of drawings of the proposed signs to the landlord for approval. Such drawings must include all of the items listed below under "City Approval and Permits" and shall be stamped by the landlord for submittal to the City of Moorpark Department of Community Development. 5. City Approval and Permits: When approved by the landlord, the tenant shall secure a sign permit from the City of Moorpark Department of Community Development by submitting three (3) copies fully dimensioned scaled drawings which shall include the following: a. A site plan showing the location of the lease space on the site. b. An elevation of the lease space drawn to scale and showing sign placement and lease space width. C. A detailed elevation of the sign drawn to scale and showing all colors, materials, dimensions and copy. d. Fabrication and installation details, including structural and engineering data, U.L. electrical specification, and type and intensity of illumination (for electrical signs). e. Any other drawings, details and information as required by City. 6. Colors: All signs shall be either reel ( #2793), blue ( #2114) or bronze ( #2412). 7. Cost of permits: All permits for signs and the installation thereof shall be obtained and paid for the by the tenant or his contractor. 8. Compliance with Code: All signs and the installation thereof shall comply with all local zoning, building and electrical codes. Town Center, Sign Program, May 11, 1993 Page 5 Major Tenants Wall Signs 1. Approval Required: All signs shall be attached to the building only at a location specified by these criteria and approved by the landlord and the City of Moorpark Department of Community Development. 2. Main Business ID Sign: The main business identification sign shall be centered on the building fascia, both vertically and horizontally, above the lease space. With the approval of the City of Moorpark Department of Community Development and the landlord, existing tenants may replace or upgrade signage based on previously approved sizes and area. New tenants shall conform to this criteria in determining size and area of new signs. 3. Delivery Entrance Sign: If applicable, the tenant may attach a sign consisting of 2" high Helvetica medium letters, identifying the business name and address on a non - customer delivery entrance. The location of this sign will be subject to landlord and Department of Community Development approval and shall not exceed one (1) square foot in area. 4. Window Sign: The business identification window sign shall be centered on the storefront glass nearest the main pedestrian entrance. The sign shall not exceed 4 square feet and shall be composed of ivory vinyl lettering (Helvetica medium letter style- shown below). Window Sign 5. Suite No. Sign: The suite number shall be centered above the door, 6" high 3m vinyl (or equal), ivory. Major Tenants Wall Sign Desit!n Sign Type: All major tenant signs shall be composed of channel letters for primary sign and channel letters or cabinet signs for secondary signs, with one (1) square foot of sign area per foot of leased building frontage, not to exceed 75 % of width of tenant's lease line at the building frontage. 2. Sign Size: Tenant signs shall be limited as follows: (except as noted in paragraph 2) a. Sign height: Primary Sign maximum 72 ", Secondary Sign maximum 14 ". b. Primary sign shall not exceed 100 square feet. e. Secondary Signs may not exceed 20 square feet. 3. Materials: a. Sign Face Material: Acrylic Sheet (i.e.: Plexiglas). Logos and trademarks, as defined in the City's Zoning Ordinance are allowed. b. Letter Return Material: Sheet metal or aluminum, painted 313 Dk Bronze. C. Letter Return Depth: Not to exceed 8" from face of building. d. Trim Cap Size: 3/4" 313 Dk Bronze. 4. Lighting: a. Type of Lighting (Channel letters): neon, 30 MA (no exposed tubing). b. Type of Lighting (Cabinets): fluorescent, 800 MA, slim -line cool white lighting (430 MA). C. All signs to be U.L. listed. Freestanding (Out Parcel) Tenants Wall Siens 1. Approval Required: All signs shall be attached to the building only at a location specified by these criteria and approved by the landlord and the City of Moorpark Department of Community Development. 2. Sign Type: All Out Parcel tenant signs shall be composed of channel letters for primary sign and channel letters or cabinet signs for secondary signs. 2. Sign Size: Tenant signs shall be limited as follows: a. Sign height: Primary - Maximum 18" or two (2) rows of 9 ". Secondary - Maximum 12 ". b. Sign Width: Not to exceed 75% of the tenant's lease space. C. Sign projection: Not to exceed 8" from face of building. d. Total sign area, per elevation, shall not exceed 75% of the tenant's lease space. e. A maximum of two street facing elevations may contain signage. 3. Logos: Logos, as defined in the City's Zoning Ordinance, when used are subject to approval of the City of Moorpark Department of Community Development a. Logo Height/width: Maximum 18" (area included in maximum allowance - see paragraph 2). b. Logo Return Color: Paint #313 Dark Bronze. C. Logo Trim Cap Color: Jewelite #313 Dark Bronze. 4. Materials: a. Sign Face Material: Acrylic Sheet (i.e.: Plexiglas). Logos and Trademarks, as defined in the Zoning Ordinance are allowed. b. Sign Width: Not to exceed 75% of the tenant's lease space. C. Sign projection: Not to exceed 8" from facie of building. d. Total sign area shall not exceed 50 square feet per elevation. 3. Sign Colors and Letter style: a. Letter Style: Helvetica Bold, Helvetica Bold Condensed or Clarendon Bold. Helvetica Bold Helvetica Bold Condensed Clarendon Bold b. End Units One sign is allowed per building frontage /elevation, with the maximum of two (2) signs per building frontage /elevation. The sign type, size, height, materials, and logos shall be as specified in this sign program for minor or major tenants whichever is applicable. Center Monument Signs (Exhibits B, C & D) 1. Sign Type: a. Double faced, interior illuminated. b. Push -thru letters. C. Surrounding cabinet to be Dryvit E.I.F.S., Quarzputz finish. 2. Sign Size: Signs shall be dimensioned as follows: a. Monument Sign Height: 5'. b. Sign Area: 15 square feet maximum. 3. Sign Copy: a. Monument Signs: 2 tenants maximum per monument sign. b. Maximum letter size: 12 ". All copy must be approved by the landlord and Department of Community Development for letter size, color and material. 4. Materials: a. Sign Face Material: Plexiglas or Lexan. b. Cabinet Material: Aluminum. C. Pole cover, Architectural elements: Dryvit E.I.F.S., Quarzputz finish. 5. Lighting: a. Type of Lighting: Fluorescent. b. Milliamps: 800 MA, slim -line cool white lighting (430 MA). C. All signs to be U.L. listed. Undercanopy Signs (Exhibit E) See the attached exhibit. Construction Requirements 1. Fasteners: All exterior signs, bolts, fastenings and clips shall be enameling iron with porcelain enamel finish, stainless steel, aluminum, brass or bronze. No black iron or other rust prone materials of any type will be permitted. 2. Conduit Openings: Location of all openings for conduits in the walls of the building shall be indicated by sign drawings submitted to and approved in writing by the landlord and Department of Community Development. 3. Sealing of Openings: All penetrations of the building structure required for sign installation and which shall have been approved in writing by the landlord, shall be neatly sealed in a water tight condition. 4. Labels: A "U.L." label must be placed on every separate electrical sign element (i.e.: every sign cabinet or channel letter). All required labels must be placed in a conspicuous location. No other labels are allowed. Town Center, Sign Program, May 11, 1993 Page 12 Exposed lamps or tubing will not be permitted. 6. Concealment of Mechanical Equipment: Raceways, crossovers, conductors, transformers and other equipment shall be concealed. 7. Repair of Damages: The tenant is responsible for assuring that the sign contractor repairs (in a good and workman like manner) any damage caused by the contractor's work within two (2) days after such damage is caused. 8. Responsibility for Work: The tenant shall be fully responsible for the work of its sign contractors. 9. Cost of Electricity: Electrical service to all signs shall be on the tenant's meters and shall be part of the tenant's operational costs. 10. Removal of Signs: Tenant shall remove sign within 60 days of vacating premises and shall repair any damage therefrom, or shall be responsible for any costs incurred to remove such signs. Prohibited Sig_nage 1. Flashing Signs: Animated, flashing or audible signs will not be permitted. 2. Lettering painted directly on a building surface will not be permitted. 3. Projections above or below the designated sign area or above the roof line will not be permitted. 4. Additional prohibited signs as discussed in Article 10, Zoning Ordinance. All Companies Bidding To Manufacture 1. Inspection: Prior to acceptance and final payment, each sign will be inspected for conformance to these criteria. Signs installed without such approval are subject to removal at the tenant's expense. Signs installed in violation of this criteria will be fined in accordance with Article 10 of the zoning ordinance. 2. Guarantee: The entire sign display shall be guaranteed for one (1) year against defects in material and workmanship. 3. Insurance: The tenant's sign fabrication and installation company shall carry Workmen's Compensation and Public Liability Insurance against all damage suffered or done to any and all persons and/or property while engaged in the construction or erection of signs in the amount of One Million Dollars ($1,000,000.0), or as provided by current ordinance, combined single limit. 4. Erection: The tenant's sign company shall completely erect and connect (including all wiring ) the subject sign in accordance with these criteria. The tenant acknowledges that the landlord gives no assurances that a sign approved by the landlord, which is in accordance with the provision of these criteria, will be acceptable to the City of Moorpark. 2. The tenant shall be solely responsible for its sign being in compliance with all local ordinances. Other City Requirements Any signs, banners, logos, advertisements not specifically discussed within this sign criteria shall be subject to the sign requirements of Article 10 of the City of Moorpark Zoning Ordinance. All signs submitted to the City of Moorpark, Department of Community Development, will be stamped and signed off by the landlord.
