SUBJECT: Consider Draft Conditional Use Permit Conditions for Weldon
Canyon Landfill
Summary
The draft Conditional Use Permit conditions for the Weldon Canyon
Landfill is currently scheduled to be heard by the Ventura County Board
of Supervisors on July 6, 1993. Council is being asked consider the
draft Conditional Use Permit conditions, reiterate support for the
project, and restate the City's concerns with the "No Project”
alternative identified in the Draft Environmental Impact Report (DEIR).
Background
On several occasions, the City has commented on the proposed Weldon
Canyon Landfill project. Most recently, at the January 22, 1993 City
Council meeting, Council considered Staff's comments to the Draft
Environmental Impact Report (DEIR). Council concurred with Staff's
findings that the Revised DEIR adequately discussed the impacts of the
proposed project and alternatives. Council also concurred with Staff's
concerns regarding the long -term impacts of two of the alternatives
studied - "No Project" and "Rail Haul" Alternatives.
As you are aware, the "No Project" alternative could result in adverse
traffic, air, and noise impacts on the City, if waste from the west
County is transported to the Simi Valley Landfill through the Moorpark
traffic routes. The City concurs with the revised DEIR that this
alternative would have significant impacts on the available solid waste
disposal options in the eastern County, and that the routing of western
County refuse trucks through Moorpark is unacceptable.
Staff from the Department of Community Development reviewed the
conditions for the draft Conditional Use Permit, and supports the
conditions as presented. Some of the more significant conditions are
included under the condition entitled, "Solid Waste Department
Requirements - Waste Flow Management Plan."
The Waste Flow Management Plan will be consistent with County and City
Source Reduction and Recycling Elements.

The purpose of the plan is to implement, "Preferred Environmental
Alternative" mitigation measures. Mitigation measures include:
a. A requirement that after a specified date, entry to the landfill
and disposal of wastes at the site shall be restricted to vehicles
originating from recycling and transfer and /or processing
facilities, except for vehicles as may be exempted per Item "c"
(below). The intent of this policy is to minimize Average Daily
Trips to the landfill and to implement mitigation measure "h" (use
of long haul trucks) discussed in EIR Chapter 14 Section G
(Preferred Environmental Alternative).
b. A requirement that after a specified date, entry to the landfill
shall be restricted to transfer trucks with the lowest available
emission engines.
C. The (County) Solid Waste Director may provide exemptions to certain
geographical areas, certain categories of waste, or certain
vehicles from the requirements of policies "a" and "b" above, if
the Director concludes that such exemptions are in the public
interest.
The draft EIR and draft Conditional Use Permit conditions are available
for you to view at the City Council desk.
On June 8, 1993, Waste Management, operators of the proposed landfill,
requested the Board of Supervisors to postpone hearings on this matter
until a later time, possibly December, 1993. The operators stated that
they want to wait until the County can further explain the role of
recycling in the proposal. The Ventura County Planning Commission
hearing for the Weldon Canyon Landfill permit application (CUP 4350) was
held on June 10, 1993. The VC Planning Commission voted to approve
postponement of the project.
The Board of Supervisors will hear this matter on Tuesday, July 6th., as
originally scheduled. Opponents of the proposed landfill are requesting
that the Board hear their appeal to continue with the hearings on the
project, and direct the Planning Commission to reconsider the project as
originally presented. Written comments should be submitted by Tuesday,
June 29, 1993 for distribution to the Board of Supervisors.
Staff Recommendation
Staff recommends that the City Council direct the Mayor to write a
letter to Ventura County Board of Supervisors expressing support for the
Weldon Canyon Landfill Permit Conditions, reiterating overall support
for the project, and restating the City's earlier position regarding the
"no project" alternative identified in the EIR.
